First off, Microsoft does NOT support consoles bought second-hand.
If you buy a used console that's banned from Live, that's your own tough luck. Caveat emptor, there's a reason it's used. Only buy refurb or new ones, so you have support. No lawsuits, no "PR nightmare"

and you'd be hard pressed to find a game that does what it does better.
Halo 3 in it's beta state could never run on a PS3 for instance, just not enough video memory to handle all the different points of display.
But the simple truth is that gameplay>graphics. That's why Halo 2 is still played like crazy on Live.
And with respect to Gears of War, if it had to handle 16 players, the amount of HUD data, and the sheer amount of scale and weaponry that Halo 3 has even in the Beta, it'd look similar.
Fact is, the game is miles beyond Resistance and Gears in Multiplayer, and for what you get, the graphics are amazing.

To download the beta with Crackdown, just start the game like normal, and go to "Download" on the main menu. there should be a box for the Halo 3 beta if you got an early enough copy of Crackdown.

The game mechanics are changed enough to make the gameplay entirely novel, yet not changed so much that it's unfamiliar.
The "Equipment" adds a new dimension to the gameplay, the active camo isn't a deleted graphic like in Halo 1, nor an exaggerated blob like in Halo 2, it works nice and is more effective over certain types of terrain.
