The Entertainment Software Association (ESA) responded to the legislation Thursday by calling the legislation unconstitutional and pointing to statistics showing that the games industry performs better than any other entertainment medium when it comes to selling mature games to kids.

It has been pointed out to us that its presence in relation to Nintendo Switch titles has been regarding the ability to purchase a Nintendo Switch Online subscription and not any DLC or other post-release content. If they keep pointing their figures at video games, I cannot see anything good coming out of the resulting actions. It doesn't solve anything and it's a scapegoating waste of time.
