Kinect recognises distinct words and phrases. Therefore, its entirely possible and quite easy for code to be written and programs running in the background that "listen" for key words.
Once spoken a brief recording period will commence. The collected audio/video data can later be reviewed by a dedicated team to discern in what context the words were used.
This is why its so important to take a stance against microsofts agenda.
