I stand corrected. TPC is owned by Nintendo. I must be thinking of Gamefreak (the devs of Pokemon).
All the evidence is pointing to a new IP (from Rare). If Battletoads is real, It will most likely be made by a outsourced company (Iron Galaxy Studio maybe, they are/currently developing Killer Instinct).
They have a contract with Nintendo.
