Deep Down Trademark Extended Again by Capcom, Implying that Development May Still Be Ongoing

Capcom's PS4 exclusive Deep Down has been in development limbo for over three years, but the publisher just provided a small signal that it might still be alive.

I'm not going to hold my breath.

Shiken2172d ago

I keep forgetting this game was ever a thing. Back in the day, PS4 gamers used to shout this exclusive from the top of mountains during the first 2 years when Sony's 1st party games were still sparse from the platform.

Now we have Bloodborne, Dark Souls 3, and God of War sporting the gameplay Deep Down promised at a much higher level of quality. I wonder if it would even be able to compete now.

Of course who knows what capcom have been doing with it during its absence from the press. Given their track record though, I do not expect much.

CaptainObvious8782172d ago

You might consider the early days sparse, but the PS4 for every single year of it's life had more exclusives than xbone.

Shiken2171d ago

@CaptainObvious878

Really not saying much there lol.

If I have a bowl of cereal with three crumbs, and another bowl with one, no matter which one I choose I will still be hungry when I am done.

WelkinCole2171d ago

No, PS fans weren't shouting from the top that this was an exclsuive to be super excited about.

butchertroll2171d ago

@shiken

"Back in the day, PS4 gamers used to shout this exclusive from the top of mountains during the first 2 years when Sony's 1st party games were still sparse from the platform. "

PS4 has more exclusive games since launch. If you think Sony's game were sparse, what the hell are MS's games?

2171d ago
Shiken2171d ago

Both were lacking exclusives. MS was the worse of the two. The PS4 lacked a major system selling exclusive till Bloodborne finally hit.

How quickly people forget...hell how quickly people assume I am an xbox fan taking a shot at Sony. I hate XBox XD

You need to take a deep breath tho

CaptainOmega2172d ago

Actually, Abriael, per N4G guidelines, I can't dictate what titles say (which isn't what I was doing in the first place), but I can report when the titles don't meet the guidelines when personal conjecture is added to them, (which is what I did).

zivtheawesome2172d ago

IMO this is not necessarily a conjecture though. extending a trademark for a game means they are still planning on developing it, whether it is currently actively in development/ back to preproduction we do not know, but this is still a sign of life from the project.

CaptainOmega2172d ago (Edited 2172d ago )

Not really. It could mean they are using the property for something else other than a video game. Implying the game is still in development based off the TM information is NOT an accurate implication.

Under "Good and Services"
For: Computer game software; Computer games in the form of cartridges, cassettes, discs or tapes; Video game cartridges; Downloadable game software; Downloadable computer games; Electronic game programs for mobile phones and smart phones; Electronic game software for mobile phones and smart phones; Downloadable game program for playing on mobile phones and smart phones; Downloadable game software for playing on mobile phones and smart phones; Screen saver software and wallpaper software; Downloadable screen saver software and wallpaper software for mobile phones and smart phones; Downloadable graphics and music via a global computer network; Downloadable graphics, music and ring tones for mobile phones and smart phones.

rainslacker2172d ago

Could just mean they want to keep the trademark because the IP is worth something, even if they really don't plan to do anything with it any time soon. They spent money marketing it, and resourced developing whatever they did do on it, and if they lose the trademark they'd lose whatever they put into it.

Abriael2172d ago (Edited 2172d ago )

There's no "conjecture."

A Capcom representative quite explicitly wrote in a legal document (which is by trademark law a sworn statement) that development is ongoing.

You can make of that what you will, but the implication of ongoing development is objectively there. Sorry, but you're reaching, and there is nothing wrong with the headline.

CaptainOmega2172d ago

The objective USE of the property is still there.... Development is just an opinion of what the extension could mean.

Abriael2172d ago (Edited 2172d ago )

The word development is explicitly mentioned in the document. It's an implication, no one mentioned it as a fact. Again, you're reaching, for reasons unknown.

As a compromise, since it really seems to bother you, I'll change it to conditional. Happy?

rainslacker2172d ago

Could be because they have to be using the trademark in some way to keep it. otherwise, the timer starts ticking on when someone else could buy it up.

ArnoDorian2172d ago

There's no guidelines breaking here.

When trademarks for an IP is registered, it is set for an amount of time, no matter if they do or do not do anything with the IP.

As to the title, it's perfectly fine because its reporting that Deep Down IP and trademarks are extended because they're still working on the game, and game development takes a heavy amount of time to make, produce and sell it to gamers/customers

-Foxtrot2172d ago

Deep down I think we all know it's not going to be at this years E3

Abriael2172d ago

Deep down I agree, but I always keep a glimmer of hope. I really enjoyed the demo at TGS 2013.

thisismyaccount2172d ago

Where you able to play said demo, and could you elaborate how good or bad it was. :)

Abriael2172d ago

@thisismyaccount: I did. It was fun. Of course it was rather early. Many liken it to the Souls series, but that's just because of the aesthetics. It really played nothing like that. Combat was a lot less brutal, and more action-adventure-ish.

jukins2172d ago

Never say never. Capcom is supposedly working on two new ips.

SirBradders2172d ago

Considering alot of Sony first party games take 4-5 years in development, its not a long shot.

KwietStorm_BLM2172d ago

A lot of games in general take 4-5 years to develop. What's PlayStation first party games have to do with Capcom and Deep Down though?

hulk_bash19872172d ago

The difference is that this game hasn't been mentioned by Sony or Capcom in the past 3 years.

butchertroll2171d ago

Deep Down isn't Sony's game. So, they can't influence development.

PhantomS422172d ago

Yeah...and Rockstar is going to release Agent too.

xX-oldboy-Xx2172d ago

It's CAPCOM and SONY - not the other mob. If they believe in the idea, they'll back it and release - just a question of when.

gangsta_red2172d ago (Edited 2172d ago )

Just like Agent right? Just a question of when!

xX-oldboy-Xx2172d ago

That's all Rockstar - and we know they do what they want, when they want.

Chevalier2172d ago

Nioh was originally a PS3 game announced in 2005 and released in 2017 12 years after on the PS4. Turns out it was an awesome game waiting to happen. Who knows maybe Deep Down might as well.

gangsta_red2172d ago

FF Vs was the same, maybe we'll get Deep Down next gen.

I think the main takeaway though is at least for FF we read updates and articles from the dev that the game was still in development.

We have gotten nothing from Capcom, not even the occasional rumor of Deep Down still be in production.

Just like Agent, we shouldn't get excited everytime a patent is filed for a game that has been extinct for over a decade.

I never knew that about Nioh, but it makes sense considering how bland the environments were in that game.

remixx1162172d ago

Eh the last guardian finally came, ffxv finally came, kingdom hearts 3 is on the way, nioh hit shelves.

I mean its possible at least deep down might make it

Chevalier2172d ago

" We have gotten nothing from Capcom, not even the occasional rumor of Deep Down still be in production. "

Tecmo Koei said nothing for the better part of a decade and the game turned out awesome. Regardless of whether you think the environments were 'bland' it was and still is a extremely well regarded game.

jukins2172d ago

Like they said if sony and capcom want it they'll release it no matter how long just look at tlg. Had basically finished the ps3 game but it was a technical mess and not up to standards. Head of studio left formed his own company and still came back to remake the entire game on a. Capable console. 1 title two generations two development cycles 1 release took 10+years. No one else would do that

gangsta_red2172d ago

Thats awesome! But this isn't TLG, it's Capcom and Deep Down.

And TLG was still a technical mess on PS4.

WelkinCole2171d ago

Dreams has been rebooted twice and its still coming. Knowing Sony's track record its safe to say it might still come someday. Heck even the Last Guardian Still came out as well.

Sony does not give up so easily on the games they believe in.

I thought this looked fun. I hope they do something with it eventually.

Rangerman1208982d ago

From what I have read, they wanted to delay the game to make the graphics "realistic". Imo, the game already looked good as it is. My guess is that perhaps they shifted their focus for a ps5 release but only time will tell.

Michiel1989981d ago

considering it looked basically better than any other game in that trailer, they were probably too ambitious. They also wanted to have endless dungeons, have several historic periods that they wanted to realize, infinite randomly generated loot. its not being made for ps5, it went in the dumpster, no way capcom would let them work on it from then on until now. it was like 9 years ago or something that trailer came out?

Ashunderfire86981d ago

I remember seeing demo footage of this game on the PS4! It already look like one of the best looking games on the PS4, like a prenext gen game before PS5.

Shinox980d ago (Edited 980d ago )

This was never meant to be a game and it was more like a showcase for their engine "Panta Rhei" that they never used in any game ( which probably named RE Engine now ) , yes this project was meant to be a low budget free to play game for the PS4 and planned to release in Japan but all of that was canceled in a matter of few months , this whole project has been silently canceled long long time ago and people does not know Capcom well when it comes to sideswiping projects

Giraiga13980d ago

@Shinox if what you said is true then that's a big shame really. I was really looking forward for the game, and it had some cool ideas and mechanics that caught my attention (though making it a F2P title was somewhat worrisome).

darthv72982d ago

I always thought it was because of this games questionable development that they were able to do the deal for SFV in its place.

SyntheticForm981d ago

As far as I'm aware not a single game was developed with the Panta Rhei engine. Some aspects of the engine may have been folded into Capcom's current engines, but who knows, really?

I thought it looked really good at the time it was shown.

Giraiga13981d ago

Agreed. The game had a lot of promise, jankiness aside. Plus, I sorta loved the survival horror aspects of the game in certain areas.

ManInRed982d ago

Still sucks we haven't heard much from it. Really liked the concept behind it, and I feel like I was one of the very few who liked the game's music. A shame it's in hiatus as of now.

Sciurus_vulgaris982d ago

I think Platinum has been overextending itself for a good while now. Scalebound was canceled after missing deadlines and Bayonetta 3 has shown nothing since its announcement in 2017.

Sciurus_vulgaris981d ago

Posted my comment on the wrong article..,

Rangerman1208981d ago (Edited 981d ago )

Like Darkborn said, you still have a good point, even if it's not related to this newspiece.

Sciurus_vulgaris981d ago (Edited 981d ago )

@Darkborn and Rangerman1208

I think Deepdown's disappearance is simply due to Capcom focusing resources on their already established IPs ( Resident Evil, Monster Hunter and too a lesser extent Devil May Cry). Despite the vaporware nature of Deepdown, Capcom has been doing quit well for the past 4 years or so.

TheExecutioner981d ago

even capcom doesnt know .. no one knows what happened

Rangerman1208981d ago

Honestly, I want to believe the game will happen but after what happened with Wild, who's to say Capcom won't consider on pulling the plug on the game?

A shame cause the game looked very interesting.

Barneyco980d ago

Excuse my ignorance but was Wild cancelled or delayed? I didn't hear news about that.

Barneyco980d ago

I looked Wild up. I had no idea it was cancelled last year. I was looking forward to it.

spicelicka981d ago

It's quite deep down this game

hulk_bash1987981d ago

Deep down seemed like Vaporware from the start. There was never anything shown beyond the initial reveal trailer.

Yppupdam981d ago (Edited 981d ago )

There is always games like this that look cool and excites everybody...and then it disappears. Look at "8 days", everything about that game looked as cool as hell, The Story, Ving Rhames as one of the characters and pretty cool game mechanics (of what video leaked out of them) That game still stings to me, I really wanted to play it.

Giraiga13980d ago

Same thing with The Getaway for the PS3. I always wanted to try out English GTA from Sony, but it sadly never came to be.

DVAcme981d ago

While the game never came out, I don't think it was time wasted. If you look well at how the camera follows the character and how it moves around during "gameplay", you'll notice it's spot-on identical to the camera in Resident Evil 2 Remake. Deep Down might have been cancelled, but it most likely became a proof of concept for Capcom in development of the REngine.

Magic_Spatula981d ago

I always thought it was a tech demo never intended to become an actual game. Pretty sure it's just them showing off what would eventually become their proprietary engine Reach For The Moon Engine or "RE Engine" as most people call it.

gleepot981d ago

capcom calls it the RE Engine, because thats what its called

Giraiga13980d ago

To quote from the other guy, it's definitely likely that Phanta Rei probably transformed into the RE engine. Still, it sucks the game might not see the light of day, especially considering how ambitious Capcom was with it.

Capcom Renews Deep Down Trademark

Don’t count this game out just yet. Are we going to see Deep Down release on PS5?

_SilverHawk_1417d ago

Hopefully its still in development and will be released on ps5 because deep down trailer looked amazing when showed years ago

Sonic-and-Crash1417d ago

i hope this to transform to " Dragon s Dogma 2 Deep Down" ....would be smart move and excellent to revisit DDogma elaborate world

Lore1417d ago

I’m hoping for both

camel_toad1417d ago

Capcom is really sitting on Dragon's Dogma and I don't get why. It was an out of nowhere fantastic game.

They need to come out with the sequel already.

Hakuoro1417d ago

That's actually what I always thought, that it was just a code name for a Dragon's Dogma game.

bouzebbal1417d ago (Edited 1417d ago )

heard good things about DD.
didnt have a chance to try it, so i hope the series gets some love cause i think it was successful.

Michiel19891417d ago

@sonic I rather hope for a Monster Hunter deep down, that could be amazing

Army_of_Darkness1416d ago

It's probably gonna be a ps5 game now.

nitus101416d ago

I will agree Dragon's Dogma is an excellent game and having the ability to climb on huge enemies is fairly unique, however, I really hope that Capcom (if they make DD2) reduces those "escort missions" or at least makes them much more interesting. Of course, if I hear "Harpy!" one more time I am going to scream.🤪

Deep down, it’s just vapor ware..

NVMGaiden1417d ago

Absolutely, I'm more interested in games that exist like Pragmata and Resident Evil 8.

Yui_Suzumiya1417d ago

Those are two games I'm most excited for as well

NovusTerminus1417d ago

Renewing a trademark is a sign of life because they cannot just indefinitely renew it, they only get so many renewals before it is rejected and open to the market again.

Relientk771417d ago

Good, hopefully we see Deep Down on PS5.

Kavorklestein1417d ago

I kind of have a feeling that Deep Down was put off until new hardware because the Quality of what we saw in the trailer looked like it was causing major frame issues and stutters on the PS4 the time.

The PS5 may finally be able to handle the visual goal of what they were going for.

drizzom1417d ago

Actually would like to see it on PC too.

isarai1417d ago

Hopefully it maintains the technology (like their fluid/particle simulations) and 4 player co-op

lildudexst1417d ago

Oh now they wanna work on it again
