Hey check this out. Don't agree to the terms if they bother your integrity. Go BUY a system and the games you want to review on Nov. 15th. Play. Review. Post review. What's so hard about that? They can add in their review that they didn't review the game as early as other "journalists" because they refuse to agree to those terms.

This FAN will listen to other FANS first and foremost, as gaming journalism is sorely lacking in integrity. If games and systems get bad reviews because of limited availability of review units, that will be the fault of the people putting out those products. It says in the article that they are sharing the payout from the last job to give players the money. You're talking about people playing on modded consoles with modded files, so I don't think sharing money with someone that wasn't involved in the job is that difficult a task for them to figure out.

This is a big problem I have with Microsoft. They love to equivocate. If it's bull just say it's bull. At first, it appears that that is what he is saying, until you go back and break it down. Games are in certification and they (whoever that "we" in his statement is) are playing SP and MP games nightly. That tells us nothing about whether they are having problems playing nightly.
