No surprise, Nintendo doesn't seem to have any ground to stand on when it comes to suing Palworld, there are enough differences for it to be it's own thing. Now, modding Pokemon into the game definitely infringes on their IP, and they probably don't want Pokemon to be associated with Palworld or guns/abuse, I can see the fun in it, but it was not a good idea on the modder's part.
If Nintendo has taught us anything, it's best to quietly release it and let it get into the wild before coping the DCMA (remember that Link's Awakening remake on PC?).
