EA bought the publishing rights to Mass Effect from MS. I would assume that hey can do what they want but there maybe other things keeping it from coming to the PS3 anytime soon. EA knows that PS3 money is just as good as MS money.
RockStar has already confirmed that there will be DLC for each version, The MS version will get 2 epsodic content packages for themselves. The PS3 and MS will also have shared content like new cars.
