MS have been known to do that previously, but it's more in regard to them discouraging free content. Left 4 Dead had something similar I believe.
From investigation for the piece a lot of policies have changed since then and the official word is that digital game prices are set by publishers.
It is however likely that there are ranges they are advised to fit in, but it's totally up to the publisher where on that scale they go, hence why EA games are ...

As I say in the article, Fez's difficulty only comes into play if you want to get everything from it. There are some of the logic puzzles that still haven't been solved.
I'm not disputing it's an awesome game, quite the opposite but it has difficulty and its ultimately rewarding

The naming and shaming won't do anything though. SimplyGames has already been blacklisted by most of the major distributors in the UK for this and other reasons.
They don't get their games from official distribution here in the UK, so there's not much that a publisher could do to stop them doing this, unless they discover who's supplying them
