Let's be honest, Kinect Star Wars could work perfectly and still only be mediocre. Losing it from the Christmas billing is no great loss to my mind.
You do have to sift through more crap on XBL to find the games that genuinely put retail titles to shame, though.

The website is there to promote Gamescom, the embodiment of the European games industry - that clean corporate image doesn't align with the vibrant industry our side of the pond whatsoever, or the buzz of the show itself. I'd be curious as to what remit the BIU has exactly when it commissions the website.

It depends on whether the studio is wholly owned by the publisher and what the relationship is. I don't know how much independence Criterion retained when EA bought it a few years ago, but as long as it's not a hostile takeover creative control is usually negotiated.
