Max Payne 3: Did Rockstar steal the new character design from another game?

Max Payne's new look seems to take heavy inspiration by another video game hero - Torque from The Suffering. Max' posture and especially the clothing bear striking resemblances to the hero from Midway's 2004 horror shooter.

Did Rockstar blatantly steal the design or is this just a coincidence?

Mainly because of the orange pants and white shirt, but it's a prison outfit so it might be a coincidence.

Tourque has got hair and Sam a huge beard though, but they are very similar...

But that mistake actually reveals what others are saying here. The new Max doesn't really remind me of the old one. I'm getting more of a generic TPS action game vibe from this than any Max Payne feeling...

No but seriously, both guys are in prison clothes so thats the main reason for the similarity. As for the posture and such... what do you expect? Max Payne ain't gonna slouch just so he don't look like some guy from another game.

It's a common prisoner look, I don't know if Max Payne was in prison but Sam Fisher in Double Agent also sported the orange pants look except he had a orange top with white shirt underneath. I can see developers being inspired by other characters in their own design, but straight up stealing isn't something they would commonly practice.

The Suffering is one of those games I thought should've made the jump over to next-gen. It was one of the better games on the original Xbox next to Path of Neo and Psi-Ops. I remember reading that Torque(just like Kratos)was one of those characters that they never got too in depth with because they wanted all gamers to appeal to him. Meaning, they didn't devulged his ethnicity because they wanted gamers to submerge themselves into the character. I thought that was a good idea b/c it seems like we are getting out of control with this image thing. I remember when CRACKDOWN was coming out, some were praising the fact that finally a game was released with a black super hero. Then when the game was released, you could actually customize your character so you didn't have to play as him while other games forced you to play as a caucasian male. Controversy ensued after that. I remember when GoW came out, they said the same about Kratos. They never wanted to give him an ethnicity even though he is cleary voiced by a black actor.

VERY similar, but I'm going to say this is a coincidence. It's not like Rockstar couldn't just throw a bunch of money at their design department to come up with their own design.

Why would they intentionally rip-off some old Midway game? it doesn't make sense.

No offense, but from the images of Max Payne 3, I'm not getting that whole neo-noir vibe that the Max Payne series is known for. I know this has already been discussed at length in other articles but I still can't believe that they did this to Max Payne. MP3 might be a good game with a good story but it won't be Max Payne in my opinion. Max Payne is all about the slick hair (which he doesn't have here) and he's not this bulky muscular guy. Max Payne is a wiry, foul-mouthed cop with an attitude. He's not protecting nobody but himself, and yet in this story he's hired to protect some wealthy family.

Max Payne wears a leather jacket because New York is a cold place with a lot of gangsters, thugs, and corrupt politicians. That's the Max Payne that the fans fell in love with. Max Payne 3 is like taking the Matrix and changing the green tinge into a yellow tinge and basing the movie in Hawaii. Remedy, poor Remedy. They spent so much time on Alan Wake, some fools hijacked their IP.

If you look at any screenshots other than the one the article's writer used, Max has tannish khaki pants. He just got the one with a weird light that made it look orange.
