A good example is the Flopstation 3, PS2, PS1 amd the psp, they all had major hardware problems, but sony lied to the public and no one took them to court. Personally, I think square should get sued for telling consumers that certain titles would come to the PS3 but then were later released exclusively on the 360 instead, and capcom for Monster Hunter 3s switch.
Reason being: Some might have bought the console with those games in mind only to have the company change their minds.

Other documents obtained from McDonald's showed that from 1982 to 1992 the company had received more than 700 reports of people burned by McDonald's coffee to varying degrees of severity, and had settled claims arising from scalding injuries for more than $500,000.[4] McDonald's quality control manager, Christopher Appleton, testified that this number of injuries was insufficient to cause the company to evaluate its practices. He argued that all foods hotter than 130 °F (54 °C) constituted a burn hazard, and that restaurants had more pressing dangers to warn about. 1.) Lady sues and wins suit against McDonalds because..surprise...hot coffee is actually hot.
2.)Man buys an RV, puts it on cruise control while driving, goes to the back to make himself some coffee WITH NOBODY DRIVING (just cruise control on), he wrecks, sues, and wins. Citing that it wasn't made clear that cruise control wasn't obviously some kind of auto pilot or something.
3.)A man breaks into a house while a family is on vacation. Through all this he ends up getting himself locked in the garage somehow with no way to escape. He is stuck there for a week with nothing but dog food to eat. He sues the family and wins!

I mean seriously, it's not just from the outside that this appears bad, it truly sickens me. And those three there aren't even close to all the cases I could tell you about.

On that note, this doesn't appear to be something like that so not exactly sure what brought up whole deal. This seems to be a legitimate case. SE allegedly lied about fees, hid penalties, etc. That's just not right. Of course somethings going to happen, and should. I don't know about 50 million dollars worth of something, but something indeed. You just can't lie in contracts like that.

I haven't played in a while and I'm not going to search the End User Agreement, but half that stuff sounds bogus or just plain common sense.

i. Licensing of the games software disguised as a sale;
ii. Monthly fees ("fees") to play the online games;
iii. Penalties for late payment of the fees;
iv. Interest charges for late payment of the fees;
v. Charges while the online game account is suspended;
vi. Termination of the right to use for late payment of the fees;
vii. User restrictions and conditions related to the online games;
viii. Termination of game data for late payment of the fees.

Half of those sound fishy to me. Sounds like a common skip End User Agreement and just sign up. Again, not sure what's touched upon but I believe the first 3 are covered when signing up. Charges while the online game account is suspended? Duh. If you're account is suspended why should they not charge you? You violated the agreement is some form and got suspended. If you suspended the account, if I'm not mistaken, they tell you that billing takes place the first of the month and that you will be billed for the entire month but once you cancel you will not be able to access your account.... Termination of game data for late payment of fees. That's just COLD. .......................

Who cares if Chrono Trigger is the same as it was 12 years ago. It's not like they have been re-releasing the game over and over again like so many others. Why do you think they haven't made another one because all the people who help make the game are gone or on other projects. It's obvious that very few people read the article based on the majority of reactions. This is a legitimate case. SquareEnix has been charging people fees that were NOT outlined in the user agreement.

SE's shadiness, when it concerns Final Fantasy XI, isn't anything new. If you remember back to August of last year, there was a big deal made in Illinois about how SquareEnix was making it very difficult to cancel PlayOnline accounts.

I really think that the plaintiffs could win this case. How is SquareEnix going to deal with a $5million hit? Is this chump change?

Does anyone play this game and/or know what their practices regarding fees and subscriptions? I know it's an MMO and it's hard to gauge how many actual users they have but if you were to look at it like WoW..100,000 gamers just doesn't seem like a large amount. SE should pay if they truely mislead customers I just can't help but think of how long FFXI has been out and now, at the end of the games life span *servers are dead on FFXI and no one is buying it with XIV coming* we have a lawsuit of this nature, seems silly and more then a lil frivilous.

Let me first say that i am NOT a SE fanboy and SE is my least fav of almost all JRPG devs (my personal opinion)

a majority of the people in this thread need to not only read everything before they comment but actually do some thinking before they comment.

this article and the court documents are saying SE deceived the plaintiff (ie: its customers) with the charges and terms in Final Fantasy XI, which is COMPLETELY UNTRUE. When your signing up for the services or making additional purchases everything is plainly stated on screen, not only that but THE FEES ARE STATED IN THE EFFING INSTRUCTION MANUAL. this will be the example of a case that goes nowhere and that is because the majority of american citizens are idiots.
an example of those idiots would be those who purchase a "port" or "remake" of a game, expecting new content on it but not doing the research to see if it actually has new content or not, then getting pissed when they dont new content. RESEARCH S**T BEFORE YOU BUY IT.

The most horrible thing about FF XI was that if you signed with a credit card (or better, you ARE forced to sign with a credit card, no other options) they'd get your money even if you wanted to stop playing, no pause. They ate me around 50 euros and when i mailed them explaining i stopped playing (something clear for them since they have the logs of everything, they saw i didn't log in for months) they told me that "i was using my character and they hoped i enjoyed my online experience".........

the funniest lawsuit iv ever heard was the woman who was driving those like..trailer homes? that are like houses on wheels or whatever, well while driving she put it on cruise control and went and made a sandwhich...of course she crashed...sued...because they didn't state that you couldn't do that...................she won.

Where was this lawsuit 6+ years ago, if it is indeed a case? The FFXI community is laughing all around because we couldn't really find an instance among us where we saw mistake charges worth suing over, where the fault of the charges was purely residual.

I don't know about the plaintiff, but I was certainly well aware of all of the fees involved with playing FFXI when I created my account. I was aware of the monthly charge, the extra monthly charge for additional content IDs you had to buy to make additional characters, the extra charges for the premium PlayOnline features, and the extra charge for Tetra Master.

If he is suing in relation to any of those charges I hope the plaintiff not only loses, but has to pay SE's legal fees.

Their Playonline subscription system is very scammy. Loved the game but the subscription side of it really needs an overhaul.

How is it scammy though? You get billed on the first of the month, no matter when you registered your account. If you had a free trial that extended into mid-month, you would be billed on the first of the following month, and you would have a prorated amount added to that bill. Oddly enough, my cable bill worked like that too. How hard is it to keep track of your bill if you know it always bills at the beginning of the month?

Seeming as they made 1.46billion I doubt they could give a **** about a 5 mil lawsuit.

I just wish they would stop releasing **** games and hurry up with FFXIII, VsXIII and XIV. Plus all the great handheld games they are making. All those will be amazing and no matter what people say on here they will buy them day one.
