Why Apple (and Sony, Amazon, Microsoft etc.) Should Support Jailbreaking

Yesterday, EFF asked the U.S. Copyright Office to grant an exemption to the Digital Millennium Copyright Act for “jailbreaking” smart phones, tablets, and video game consoles. The exemptions are designed to dispel any legal clouds that might prevent users from running applications and operating systems that aren’t approved by the device manufacturer. The exemptions stem from section 1201 of the DMCA, which prohibits circumvention of “a technological measure that effectively controls access to a work protected under this title.”

hahahahahahahahahahahaha, sorry I couldn't help but laugh at this. You let people do Jailbreaking on consoles then you going to get people wanting to do bad things (I think we all can get what I mean and if not then oh well).

That is like leaving all the jail cells open and hope no one will take off and leave their cells.

Jailbreaking should be legal on consoles as they are on mobile phones. There is no difference.

Pirating a 99 cent game is a big difference compared to a 60dollar game. Jailbreaking may have advantages for us but its gonna kill some developers, Thats what the EFF doesnt realize.

jailbreaking an iPhone - now it's not exclusive to one carrier.
Jailbreaking a game console - now you can "backup" your games.

No difference? Here's a thought. Why don't you take all the money that jailbreaking a ps3 will cost, go buy a Dev kit, and make fully legit homebrews? Or do you have something else in mind?

You should have a right to hack your hardware anyhow you want. Of course, Microsoft have the right to kick you off Xbox Live if you do, but that's their right, and it shouldn't encroach on yours.

Then again, you guys are probably the only fans of SOPA's DNS blocking and deep packet inspection from your ISP. Right?

Because your fundamental freedoms are worth less than a $60 game. Congratulations N4G, congratulations.

It's all well and good posting all the positives and saying, "Hey, look at how much good it can do", but there are also negatives.

For instance, some jailbreaks allow users to pirate games and get them free of charge. So in that sense, you can't really blame the likes of Apple, Sony, Microsoft etc for not jumping with joy over jail breaking because at the end of the day, they also have to keep their partners happy i.e. the developers that make these companies what they are in their respected divisions i.e. applications and games.

In a perfect world, we would have people who are jail breaking but with the intent on brining more functionality to users etc, but quite obviously this is a less than ideal world.

I don't understand n4g. I've been coming to this site for a long time, and the people here must be between the ages of 12 to 18. The software that these game consoles have is the companies. They provide us with a license. That's very well known, but these guys are fighting for the right to do whatever you want with the HARDWARE!! If Sony wants to remove the os fine but the hardware is ours to do with whatever we want. So if someone wants to write code for it then he should be able to. Are we renting these machines from them? No we bought them!! They control the software. We HAVE a right to do with the HARDWARE whatever we want!!

You do know that if you use a gun you can kill someone right? you do know that if you stick a fork in a wall socket you will die right? The point is that people have the right to do whatever they want!! Why do you think a company creates a ToS? Cause they have a right to protect their investment right? Well so do we. The argument you'll probably come back at me with is " Well they're made for games! If you want homebrew theres computers for that!" While that may be true. We shouldn't deny the fact that we bought the HARDWARE. Its ours so we can do whatever we want with it. Covering your ears to the truth and screaming " la la la la" wont make it go away. I work very hard for my money and after the house and all my bills are payed, if I buy something i don't need anyone telling what i can and can't do with it!!

Feel free comparing jailbreaking your system to other things out there, but keep in mind that it's not the same.

Video game consoles are designed to play video games of a certain format. That is as basic an explanation as you can get. Other functionalities may be added, but the basis is to play video games.

But consoles are also capable of a lot more, if they are "unlocked." One of these things- the most common and prevalent use for jailbreaking- is to play unauthorized copies of games.

To be honest, I don't give a shit about all this other "protecting the corporate interest" and "your fundamental freedoms" bullshit you want to spout. You're just trying to use that as an excuse to do what you want, when you want, simply because you own something.

Nobody's making it illegal to OWN your console. It's illegal to enable it to do illegal things. Owning a gun doesn't mean you will shoot someone; that's YOUR action to take. But the ramifications of such an action usually prevent people who own guns from taking that action. Having a car doesn't enable GTA. And, quite frankly, I'm having a really hard time NOT calling you something insulting.
