Judge guts suit against Sony for killing Linux in PS3

A federal judge has dismissed all but one of the claims leveled against Sony for dropping Linux support from its PlayStation 3 game console, but gave the plaintiffs permission to refile an amended complaint that fixes the deficiencies.

A complaint seeking class-action status on behalf of all PS3 owners was filed in April and claimed that the disabling of the so-called OtherOS violated a raft of civil laws, including those for breach of warranty, unfair competition and computer fraud. Sony had touted the feature, which allowed users to run Linux and other software on their consoles, in interviews and presentations, but later dropped it after a well-known hacker figured out how to exploit OtherOS to jailbreak the PS3.

Which is hard for them to do considering it says right on the box of PS3 sold that features may change as Sony sees fit.

And also that nothing mentioning OtherOS was EVER printed on the box. Also, you have to agree to the EULA when first booting your PS3 (which includes the clause that Sony can take features away). So...yeah... Their chances of winning out on Sony aren't good. What's sick is that even if they DO win, they'll only get about $20 (which is how class action suits generally wind up paying out). So here they are taking up all of Sony's time and money for a feature that doesn't matter AT ALL, when they could be using the PS3 for what it's designed to do.

Now, if Sony removed the ability to watch BluRay movies, I'd be ticked.

I never cared about Linux, I have a way better computer at home.

Thanks sue-happy fkrs - now companies have more incentive to give less features, for fear of law suits. Why give more if upon discovering some security risk, or cost liability companies can't remove it, may as well give the consumer bare bones.

... or it will prevent companies from making false promises and removing features after they sold you the product. Next on the list for removal is Blu-Ray!

Yes that makes perfect sense.

Sony will physically come to your house and remove the Blu-ray drive from your PS3, disabling the capability of playing any games or movies.

They removed 1 feature, Other OS, which almost no one used.

False promise you say?
Did they promise they would not remove Other OS ever?
It was stated that Sony had the right to remove it at any time as part of the user agreement. It's also on the box!

I'm not how you came to that stupid conclusion, but Sony can just disable it in software. No software, no useful hardware.

Never in history that I know of, have any company taken away a feature after it was sold without compensating their customers.

I don't care what is in the license agreement, as a lot of it isn't necessarily legal. You can't sign away your rights, even if you stand in front of a judge and agree. Besides, does that mean that I can't speak up if I dislike it?

False promises? Oh there are so many, but the executives advertised the console as a super computer that had gaming ability, now I'm forced to choose between using it as a super computer or a gaming device, but not both. That is not a choice!

Either way, this is less about your PS3 than just about everything in your home will eventually have software on it that will have a license agreement preventing you from using it in any manner you want including installing third party parts.

... but it seems most people here don't care, they only care about their beloved PS3!

Sony is not going to "disable" Blu-ray, otherwise they'd be selling videogame consoles that don't play videogames. Don't you understand that it makes no sense!? Was the argument of "Blu-ray" the best you could do? Try harder!

THINK, why was Other OS removed? The answer is hackers.
The PS3's primary function is that of a videogame console and multimedia, NOT Other OS.

No, you're not forced to choose between a super computer and a gaming device. Don't lie and pretend like you care.

If you wanna use Linux, any old computer will run a better version of it.

PS. Don't be angry just cause Team Ninja made both Ninja Gaiden games better on PS3 xD

My point was that any feature can be disabled at will via software for whatever reason Sony would like to spin.

Yes, I don't care if I can run it on my old Pentium 3. I was promised a feature when the console was sold, and I can no longer use it. I don't care if hackers did something, that is not my problem and shouldn't affect me.

Still did Sony disable OtherOS change the fact that pirates can still pirate games? As far as I can tell, pirates are enjoying their PS3 and their free games.

I got one less feature on my console and I buy all my games legitimately. I shouldn't have just pirated it like everyone else.

It doesn't matter to me if PS3 get's the Godly version of Ninja Gaiden, because I got all three consoles. I can pick and choose at will. However, the in my personal opinion (and probably most people on Iberian's Realm) think the NG2 for Xbox 360 is still better, but this is completely irrelevant to the discussion.

Either way, you sound like an irrate fanboy, so I guess there is no point in discussing as you will just pull me down to your level. Heck, you already have!!!

But you DID get the feature they "promised".
They NEVER PROMISED not to take it away. It's under the license agreement and on the box that they reserved the right to remove that feature. This was only if you bought an older PS3 phat.

It's weird that only you people care about these so called "false promises".

Other OS was NOT a key feature of the PS3.
No other main feature(such as Blu-ray, online functionalities, video, music, etc) would be removed, as it would be unnecessary and to think that Sony will handicap their systems by disabling important and main features is just seriously dumb.

Other OS is gone and no one even remembered it was gone until these stupid articles about court cases came up.
