That physical versions of Nintendo Switch 2 Edition games will include the original Nintendo Switch game and its upgrade pack all on the same game card (i.e. they are exclusively Nintendo Switch 2 game cards, with no download code). Alternatively, some publishers may release Nintendo Switch 2 Edition games as download codes in physical packaging, with no game card.

The money that Nintendo lost on Wii U, they made up for on Switch, but still, the loss is still there. All guns blazing with Switch 2 pricing, suing Genki is a 'we need to make money' exercise. Goes without saying that Switch 2 will sell out at launch, but once it settles down, the masses won't pay it.
Genki abused its position as a partner to drum up hype for their business so they deserve the lawsuit however it's not going to be blamed for missing any targets
Pretty clear cut here they were under a partnership agreement here they violated that

I think Wild Heart S is the first failed Switch 2 port. Even Switch 1 can handle how ugly the port is.

I wonder if there are any differences at run-time for these Switch 2 Editions given they may not be recompiled binaries (instead operating via emulation or hardware translation layer)...

Great news! At least Switch 2 cartridges is a legit physical version.
