FTC is Denied in Attempt to Extend Restraining Order. MSFT & ABK Can Close This Weekend

The FTC has lost their last second appeal to the 9th Circuit Court. They have denied the FTC's attempt to stop Microsoft from closing with Activision.

AngainorG7X700d ago

That’s the way it should be. Finally…

Welcome Activision Blizzard. 💚

Jin_Sakai700d ago

Yea welcome to industry consolidation.

sparky77700d ago

Which has been happening since the beginning of the gaming industry.

-Foxtrot700d ago

They won’t complain until all the negative shit happens and then the same people will be like

“How did this happen”

Whether it’s MS, Sony, Tencent…nobody should be allowed to have two major publishers and say “It’s good for the industry and gamers”.

darthv72700d ago

On one hand its consolidation... on the other its expansion. all depends on which side of the isle you are on. I'm covered either way.

Outside_ofthe_Box700d ago (Edited 700d ago )

Let's go! Thank you Microsoft for bringing much needed competition into the industry! Things have gotten complacent with Sony as the dominant market leader. Can't wait for Microsoft to reach their goal of becoming the market leader by 2030! Hopefully Microsoft buys Take2 next to put even more pressure on Sony to be better! We need them to spend Sony out of business! Gamers everywhere have finally won!

Tacoboto700d ago

"It's bad for the industry!"

Activision, their business practices, their treatment of their employees, their treatment of their fanbase, and their own consolidation around COD/GaaS is more than bad for the industry.

4Sh0w700d ago

Finally, FTC never had a case, just headed by some young hotshot lawyer trying to make a name for herself.

Jin_Sakai700d ago

“Which has been happening since the beginning of the gaming industry.”

Since when have major 3rd party publishers such as Bethesda and Activison been bought since the beginning. Please tell.

Jin_Sakai700d ago

“On one hand it’s consolidation... on the other its expansion.“

Like making Redfall, Starfield, and Indiana Jones exclusive and taking them for the competition. That’s expansion alright.

Neonridr700d ago

Ultimately it's only exclusive if you choose brand loyalty to one box. 😉

Jin_Sakai700d ago

“Ultimately it's only exclusive if you choose brand loyalty to one box.”

Ultimately I had a choice before now I don’t.

maniacmayhem700d ago

The new N4G buzz word is "consolidation"

I guess we needed something new other than "monopoly"

4Sh0w700d ago (Edited 700d ago )

Jin

You still have a choice, live with it. I mean more than 75% of people in UK= people CMA represent did NOT think the deal hurts competition. A judge listened to all the facts and not only did she NOT think it was bad for consumers, she actually concluded the deal was good for consumers, another higher appeals court agreed, 39 countries approved, soon the CMA will fold, so it seems the only people who swears this will ruin gaming are those out on PlayStation Island all alone by themselves.

Abriael700d ago (Edited 700d ago )

@Jin_Sakai: I bet when it's Sony keeping games from the competition you don't mind.
"but sony does it differently!"
The way they do it is irrelevant. What matters is that they do.

Here's my advice. Buy a good gaming PC. It'll open your eyes to a big, awesome world beyond this silly console war. It's not cheap, but it's worth it.

Sonic1881700d ago

This is only the beginning. Microsoft ain't stopping

InUrFoxHole700d ago

@Jin
Just stop man. It's over....

victorMaje700d ago

@Outside_ofthe_box

You gotta make a product to call it competition, in this case they straight up bought the product makers…there’s no competition, they lost then went Pay 2 Win…

700d ago
umair_s51700d ago

What is wrong with consolidation?

Roiu89700d ago

when you have both ps and xbox exclusivity doesn't come into the conversation anymore and looks to be the way forward

umair_s51700d ago

Time to finish the fight

1konrad700d ago

It the beginning, Microsoft greedy monopol strike gamers soon.

Montrealien699d ago

Jin_Sakai asked "Since when have major 3rd party publishers such as Bethesda and Activison been bought since the beginning. Please tell."

Could you please clarify your understanding of videogame history? It seems that there might be a discrepancy between your knowledge and your confident demeanor. I'm curious to know why that might be the case.

I mean, we could start with the purchase of a 1st Party? When Atari was purchases by Warner Communications in 1976,

And then, in the spirit of you question for the 3rd parties, I have a few examples.

Infocom: In 1986, Activision acquired Infocom, a game developer and publisher known for its text-based adventure games like Zork and The Hitchhiker's Guide to the Galaxy. The acquisition allowed Activision to diversify its game catalog and expand into the interactive fiction genre.

Brøderbund Software: In 1998, The Learning Company acquired Brøderbund Software, a game developer and publisher known for titles like Carmen Sandiego, Prince of Persia, and Myst. The acquisition aimed to combine Brøderbund's successful franchises with The Learning Company's educational software offerings.

Cinemaware: In 1995, Sanctuary Woods acquired Cinemaware, a game developer known for its innovative and cinematic titles like Defender of the Crown and It Came from the Desert. The acquisition aimed to strengthen Sanctuary Woods' game lineup and enhance its production capabilities.

Jin_Sakai Said..

"Like making Redfall, Starfield, and Indiana Jones exclusive and taking them for the competition. That’s expansion alright."

I understand your perspective, but it's important to note that while exclusivity deals may limit the availability of certain games on different home hardware consoles, the modern video game market has expanded far beyond the boundaries of traditional consoles. Nowadays, there are various platforms and distribution channels that have significantly broadened the reach and accessibility of video games.

For instance, PC gaming has always had a significant presence and continues to thrive as a major gaming platform. Additionally, mobile gaming has experienced explosive growth in recent years, with smartphones and tablets becoming increasingly powerful gaming devices. Furthermore, cloud gaming services have emerged, allowing players to stream games on multiple devices without the need for high-end hardware.

Moreover, independent developers now have more opportunities to create and distribute their games through digital marketplaces like Steam, Epic Games Store, GOG, and others. These platforms have opened up avenues for smaller studios to reach a wider audience, giving players a diverse range of games to choose from.

While it is true that exclusive titles can be seen as a form of consolidation for specific platforms, the overall video game market has become more expansive and inclusive. Players now have access to a vast array of games across multiple platforms, catering to various preferences and play styles. So, even though some games may be exclusive to certain consoles, there are still numerous options available for gamers to enjoy across the diverse and ever-expanding video game market.

Lightning77699d ago

According to the judge its not Consolidation, not even close actually. Judge Corely only cares about facts and numbers with these cases and everything adds up in MS favor. The ABK deal didn't makes sense to me personally but it's far from consolidation.

Uh, FYI, Activision/Blizzard games were already on Xbox.

sparky77700d ago

Next week the gaming landscape could be changed forever...

Battlestar23700d ago

MS will still be in 3rd place in consoles though. Activision is not going to help MS outsell Playstation consoles or even Nintendo.

YodaCracker700d ago

Purchasing Activision was clearly never about selling consoles.

sparky77700d ago

Console sales are not important anymore, revenue is what matters and MS is about to change things drastically.

luckytrouble700d ago

Microsoft doesn't care about selling consoles. They ostensibly care because that's what the gaming market has been for so long, but look at Gamepass. That's what they care about and it's all they care about. The console market can sink for all they care as long as they can find ways to dispense Gamepass via cloud gaming or otherwise on hardware people already have on hand anyways.

Asplundh700d ago

Probably not but they'll be a couple more steps up the ladder and in a better position.

autobotdan700d ago

The top best selling digital games on Playstation consoles the last 3 years have been Call of Duty and Minecraft. Microsoft is now Playstations most important 3rd party publisher.

700d ago
COS699d ago

Their plan is geared more towards mobile gaming, that is where the growth is at. Look at Apple and Andriod marketplace, they dwarf the console space.

343_Guilty_Spark699d ago

You are free to play console wars by yourself.

Neither Nintendo or Microsoft care about it.

@Yoda if you think that then you missed Phil Spencer saying in court that buying Activision is key to helping MS combat Sony and Nintendo in the market and become number 1 in gaming.

arkard700d ago

Phil Spencer has been proven to say one thing then turn around and do another. I wouldn't trust anything he (or any other suit) says

699d ago
blackblades700d ago

If consoles arent important why not go 3rd party then

4Sh0w700d ago (Edited 700d ago )

Because consoles are just 1 way to push your subs and other services NOT the *only way to skin a cat, I mean unlike Sony -which btw is perfectly fine, look at other industries very different strategies gives the consumer clear choices, rather than just a different color box.

Blashted700d ago (Edited 700d ago )

The fight is over and Microsoft can now close the merger as early as 12AM PT Saturday. Microsoft will now own Call of Duty and former PlayStation/Naughty Dog mascot Crash Bandicoot. With the 360 Call of Duty servers being fixed the last couple days and the eventual Game Pass release of all CoD games, it will be interested to see the future of Call of Duty and what this means for PlayStation. I'm sure Jim Ryan is looking as red as ever. Only time will tell if Microsoft can save the already dying franchise. Happy Friday everyone

Speak for yourself. Im happy MS was able to close and soon I can save $60-$100 bucks a year not having to buy CoD. It’s only a sad day for haters…

MaximusTKG700d ago

You do realize that you are still paying for it? Right? You do understand how subscriptions work? Instead of a one time pop of money you give them access to your bank account on a monthly basis. Oh, you were going to cancel after a month but forgot? Easy $15 for Microsoft no matter what you do.

UltimateOwnage700d ago

This is a $75 billion acquisition. Microsoft has deep pockets, but let’s not pretend this won’t come out in higher prices or major job cuts somewhere, possibly to the studios themselves people you like you are clamoring for this deal to close for. Enjoy 3rd place, with a shell of what Activision once was (which honestly isn’t great based on its employee morale and leadership).

Anomander700d ago

@Maximus With MS Reward points I haven't had to buy subscription pass in over 6 months. Between the games not on Game Pass and then buying games from game pass I earn enough points each month to get a new monthly pass added on to my subscription.

purple101700d ago

I must say playstation has exclusive marketing rights till 2024. So that's this years new cod included. Maynot be on gamepass and you may still have to pay $60.

Just saying.

andy85699d ago

But the more frequent gamepass price hikes once this deal is done you'll end up paying more anyway 😂

Battlestar23700d ago

I guess since some Xbox fans want MS to buy Activision so badly and champion consolidation. If Sony decided they wanted to buy Square Enix and Capcom and who ever else they could afford then these same fans wouldn't object to it happening right? I mean if MS can buy whoever they want then Sony or even Tencent or Amazon buying up studios/publishers if perfectly fine too.

YodaCracker700d ago

If Sony puts all SE and Capcom games on PS Plus day one, and brings PS Plus to more platforms then I’m all for it. The thing about the Activision acquisition is it brings their games to more platforms than ever, and for a lower price. All these games on Game Pass will force Sony to improve PS Plus. The benefits far outweigh any negatives to consumers.

Battlestar23700d ago

Again if you believe MS will keep every Activision game multi then your living in a dream world. In the court case the contracts that MS got other companies to sign have a get out clause for MS if they deem having Activision games on other services is not making a certain aount of profit which wasn't mentioned then they could cancel the contract easily. MS aren't afraid to take a major dent financially if it meant them making money later.

Phil Spencer said in E-mails in the court case that from day 1 Bethseda games will all be exclusive with the exception of Deathloop and Tokyo Ghost Jungle. The case by case basis was a lie.

Also Sony will never put PS+ on other platforms just like MS will never actually put gamepass on PS nor Nintendo devices.

MS thinks that Activision will help them beat Sony in the gaming market but they are wrong it may help a bit but Sony has more staying power and I'm a Xbox fan first.

metalhead700d ago

Where gamepass for PS5? Please stop talking. Xbox isn’t bringing gamepass to anything but Xbox and PC.

343_Guilty_Spark699d ago

@Battlestar23

Its going to be okay.

Tacoboto700d ago

If Sony still enables Square to release games on Nintendo and PC on titles with appropriate fan bases, what's the harm?

They've already made their biggest franchise effectively PS Exclusive.

"Or even Tencent" lol where have you been? They're up there like Embracer

Masterchief_thegoat700d ago

Dude Xbox fans don’t care. if square get brought by Sony. They barely get jrpg from them. Only thing they might is probably resident evil. Street fighter was skip on Xbox with sf5. Monster hunter is big for both Nintendo and sony. Plus I doubt square enix wants to be brought. Since they’re enjoying Sony and Nintendo money. Idk about ms yet since they don’t have a strong relationship at the moment

Sonyslave3700d ago

Yup 100% Square can go and Capcom might pull a Zenimax and side with Microsoft.

Same like Sega was all over Sony$$ going back to ps2 days, just came out a week ago saying xbox value them more than any of the big 3.

CBaoth699d ago

yea Capcom might go with MS! Are you fucking retarded? Serious question. Sounds what xclowns want now - buy Capcom, Sony can have SE. But no SE doesn't want bought according to bots. They like Nintendo money but Bethesda probably hated selling 20 million copies of Skyrim on PS. They begged MS to buy them lol

goldwyncq700d ago (Edited 700d ago )

I wouldn’t. Square Enix’s biggest games are already PS exclusives anyway so they might as well buy them and make it official.

Sonyslave3700d ago

Sony cant afford no capcom and Se lol maybe one, Plus sony don't have the $$$ like MS, i have a hard time seeing Jim Ryan convincing the top dog at Sony corp to spend 8 or 10bil on square enix or capcom.

Also Square said last year they not up for sale lol and Sega said no and Capcom well idk.

tay8701700d ago

The way capcom has exploded the last yr, I highly doubt they are willing to sell to anyone. They improved their value by 50% last yr. Sega isn't going to sell to MS or Sony either. Square is by far the most likely Japanese publisher to be aquired next. They clearly have been making moves to be aquired. Their extremely tight relationship with Sony screams upcoming aquisition.

-Foxtrot700d ago

"If Sony decided they wanted to buy Square Enix and Capcom and who ever else they could afford then these same fans wouldn't object to it happening right?"

If they did in this hypothetical scenario then people still would complain, the same ones who have been wanting this to go through

They'll call Sony hypocrites despite the fact Microsoft has changed the game and allowed these things to happen, what's Sony going to do? Not do it? Then when it becomes bad, the blame will be shifted at them.

It'll be a reaction, after reaction

DEEHULK88699d ago

People seem to be dreaming up ways why this is bad. Consolidation would happen anyway because Activision WANTED to sell. So, if Microsoft wasn't buying, someone else would be. I think that Microsoft buying them is the only reason why people are complaining imo.
