Complicated issue but this is basically the effect of draconian laws like copyright/trademark/patent. You shouldn't be allowed to own ideas but right now that is the law.

Isn't creating or interpreting art a legal construct? This is why any artist can cover any other persons song. Imagine if that was copyrighted, no one would ever be able to play the art (performance) in their own vision.

This is why copyright has been a means of control than innovation that I suspect was the purpose behind this ages ago. Companies now just push the copyright years.

Not entirely. Most song covers can be done "live" without any kind of permission necessary. But when you have "covers" on the radio, there normally needs to be an OK from the artist/label - hence why there are so many lawsuits around even using similar note patterns (see: Ice Ice Baby or Blurred Lines). Art is a tough medium to figure out fair vs. not.

Fan Art is fine in-and-of-itself, but when you start getting paid for it the waters get muddy; becomes a bit less "fan art" at that point. Sort of the same way developers can't just borrow other game characters for their games - else they profit from that IPs popularity - this guy can't make money from making art based on Nintendo's IPs. Not exactly cut and dry, but I understand. Especially when having to set precedent for "protecting your IP".

I agree, wether its fair or not is up to debate. That's why engineers love companies like tesla which challenge others to beat them at their game and for many other reasons of course.
