if it was listed in the section where consoles are sold, the buyer will get their money back. you're not allowed to list empty boxes in with the actual products - it's deceiving.

The item was accurately listed in both the title and description, assuming it was posted under misc items and not in the console section, the seller did nothing wrong. The buyer is 100% to blame for choosing not to read anything before bidding.

Ebay has a policy against selling empty boxes. While it's often overlooked for some products, mainly collectible type stuff, technically, someone could lodge a complaint against an auction and get it taken down. The policy is pretty strictly enforced for electronics products however. Most ethical sellers will make it plainly obvious, and more than just a line in the title and description. At least that's what I've seen with game boxes, particularly older games.

Basically, it doesn't matter how obvious he made it, it's against ebay policy.

Whether that policy is a bit overblown is a different discussion, as Ebay does 99% of the time they will side with the buy should they feel like they didn't get what they thought they were going to get.

That's because most bids come in at the end of the auction. When people see a good price, they often bid without actually paying attention to what's actually being sold.

That is the buyer's fault of course for not paying attention, but at the same time, some sellers know this and will take advantage.

The only way you could say its deceptive is if the reserve price was comparable to a real console. For all we know it started at 99 cents and the bidding drove it up.

Having gone and looked at the actual listing it started at $99 so yes its definitely sneaky and they did this deliberately.

I still think people should use a bit of common sense but and look at what youre buying when purchasing online. I mean seriously, 25 people, it mentions in 2 places its just a box, and no one even asked the seller a question. I hope that never happens to me, but I also hope I'm never that dumb.

Buyer will win dispute since it is listed under consoles. That is against eBay terms.

This happens because people use the Ebay app to buy things. By default it covers up the description so you only see the picture, title and category it's listed in. Combined with the hype of bidding in an auction, many people miss out on the details.

Again, smartphones are responsible for idiocy.

Why was this approved... it happens all the time, buyer gets their money back EVERY time cause it was listed in 'console'. This is not news.
