Playing MW3 Before Release might still get you banned

Yesterday, Director of Policy and Enforcement at Microsoft said this on Twitter, explaining that there would be no penalty for playing Modern Warfare 3 before release day on the Xbox 360.

Update:

The article is updated to accommodate the statement recently released by Activision.

i remember having an argument with a friend about this, it don't make sense if you somehow got MW3 or whatever game early that you could get banned for playing it early. I understand if its not legit it makes sense, but i know lots of people who get games days before i do and their buying them legitimately.

“We value and appreciate the community’s support. We have no interest in banning legitimate copies in these last few days,” Activision told Joystiq.

How does it play? Does it have performance issues like black ops on the PS3?

Looks like you have a bad copy of the game. My Black Ops PS3 copy works just fine.

I think he means if the PS3 version is better optimized this time. The PS3 BO version did have a lower framerate than it's 360 counterpart, as did previous MW games.

I also want to know this because I'm really hoping the PS3 version comes closer to a steady 60 fps this time...

They won't be banning anyone if your copy is legit. They have no right to.
If you have a legit/legal copy, there is nothing they can do.

Its their online network and they have every right to, not that its right (Its complete BS in my opinion)

EDIT - To the disagreer, so you're saying although its activisions own online network, they have no reason to ban you for anything regardless of what you do? Think someone here needs to reads those T&C's they accept before playing online :/

It is their online network, but they can't ban you for no reason. If you get a game early, there is nothing in their terms and conditions to authorise them to ban you.
If it was the case, microsoft could get your yearly sub and then ban you making easy money.

They can ban you for whatever, whenever they feel like it.

Its known as a private agreement, and I guarantee within Acti's TOS you will find a line that states

'We reserve the right to refuse access......'

Some consumers could inadvertently bought the game not knowing, so no banning....

Since its not released to the greater consensus yet, you'd be playing with a very small amount of people... Would it even be worth it?
