Sony T&C: No Liability For Data Loss

The Internet is awash with people demanding compensation as their personal data is now in the hands of hackers but they may be in for a shock if they take legal action against Sony. MCV has noted the following statement in the Sony Online Terms & Conditions:

We exclude all liability for loss of data or unauthorised access to your data, Sony Online Network account or Sony Online Network wallet and for damage caused to your software or hardware as a result of using or accessing Sony Online Network.

Sony may be liable to a fine from Information Commissioners Office (ICO) of up to £500,000 if they are found to have broken the UK Data Protection Act but it appears that individual PSN users will not be able to claim any financial compensation.

Sony has not gone out and said that

did u read the article

maybe we should wait and hear it from Sony before we Decide if its fair or not

I also bet you will will find terms like that in almost every online agreement you sign nowadays

Uhm hello? you always run a risk when you give out your card information anywhere. you're safer if you don't give it to random sources that are unheard of i.e. internet scams.

Usually the card bearer is the one who makes that decision and should take responsibility over and consequences for taking such risk.

That being said, i think the chances are still low.

People always skip the Terms & Conditions, They just "agree" without reading, Then they start to claim and think they know it all... I just cant wait to have my FREE Service back. I Cancelled all my account and open new ones, all done via internet.

You obviously have no idea how the law works. The terms and conditions are something every PSN user agreed to, if they went online. Therefore if you try to go to court the defense attorney will present the terms and conditions to you on the stand and you will have agreed to them, therefore you lose. Did you really just say that, man some people should not comment on things they have no idea about.

the problem isn't just about the data loss, it's about taking a WEEK to told your consumers that their credit card number was stolen.

I don't have any problem with changing my credit card number, bad things can happen and I understand this, but a whole week?

Terms and conditions are RULES, not law. They are rules set forth by said company, in this case Sony....but they don't necessarily hold up to the scrutiny of court of public opinion or court of law.

For example,
Lets just say that I was part of bank, or any other large company. I tell you that I'm gonna loan you $1000, but you have to give me 50% interest all paid in 2 years. You agree, and you even sign various contracts.

Guess what? That's loan sharking and it's illegal. And furthermore said contract is null and void in any court in the country.

Yeah, my contract which you totally understand and agreed to says one thing, but the law says another.

Don't confuse RULES vs LAW.

He has no legs. The risks are spelled out. You obviously have no idea how court works. Sony did not loan shark. He was advised of the risks and still accepted that. Its called a mitigatig factor. Im not confusing anything. Just wait. The outcome will prove my point. Now please shut the fuck up bc u have no idea how the system works and I fucking do u little pukes.

Sony might not have to legally make good on damage to users but they probably will in order to rebuild consumer trust. It might not be as costly to them as say, a 3 year warranty but they will give users something.

I don't want Sony to lose money...I want them to learn...improve...and fix.

I will quite happily waive this instance...just sort it out please x
