How Stolen Footage Ended Up In The Forza 4 Trailer

The trailer for Forza Motorsport 4 contains video taken from another filmmaker without his permission. The cause? A well-meaning but short-sighted director with a first language that isn't English.

The trailer for the new Forza 4 game is mostly made of live action shots from Top Gear USA and two other sources: Clash Productions of France (which Microsoft licensed the video from) and the trailer for the web-series Turn9 by Tim Whitcome (whom Microsoft didn't license the video from).

Microsoft was adamant today indicating they did license those four short snippets of video while the director of Turn9 insisted the video was never licensed to anyone. What happened in between is an international game of telephone gone wrong. (Forza Motorsport 4, Xbox 360)

I think its because GoW 3 was absent so MS needed a exclusive in the VGA's so they made a Forza 4 trailer quickly

That's exactly what I was saying. They need to compensate because they are accountable for green-lighting the trailer. They were poorly prepared and handled things improperly due to time constraints (I assume)

Also "...It turns out the people who created the trailer for Microsoft..."

I knew MS didn't "Create" or "steal" the trailer. It was passed to an advertising company who screwed up, all because everything was done in a rush (I assume). People were quick to point fingers at MS for purposely stealing the thing when in reality it was the guys who created the trailer that misunderstood.

Ultimately it doesn't seem to be a big deal considering it was an honest mistake and Whitecome seems to understand that.

They should compensate us by making a proper trailer with all Ingame graphics & gameplay
Convas  +   1363d ago
I was of the same opinion Alpha. This was simply a misunderstanding.

Too bad the simpletons on this site with personal vendettas against MS didn't get that when this story first came out.

Why do they need to compensate us? They need to compensate the actors like it says in the article.

I don't see the big deal, it was an honest mistake that Whitecome himself understands. It's not as if MS deliberately stole it. Again, I assume the miscommunication was part of the time constraint.

"the people who created the trailer for Microsoft are a fan of Benini's work and asked if they could license some of his video."

Seems like the guys who made the trailer were under pressure-- I wonder how late MS asked them to make the trailer-- and as a result they had to use existing footage.

Ah yes, the good old Fanboy Entitlement Act of 2010, what the hell were those politicians thinking when they passed that? They'll ruin the industry!

Another case of out of touch politicians trying to orchestrate the games industry. Damn.

@BlmThug
When has MS ever used in-game footage of a game to sell that game? Certainly its never been the focus.
ChozenWoan  +   1363d ago
So let me get this right....
it's not MS's or Turn 10's fault that the Forza 4 trailer contained stolen footage?!?!

Turn 10 is making the game!

If anyone should have footage suitable for making a trailer it should have been them. On top of that, why didn't MS pressure them at the last min to make the trailer instead of some ad agency... Who Is Not Working On Forza 4 by the way.

That's like having a contractor working on your house. If he goes out and hires a sub contractor who ruins your house, who are you going to sue?

Same logic applies here. Spike TV had a contract with MS for a trailer, MS hired a sub who botched up the job. So who is to blame in the end?

"That's like having a contractor working on your house. If he goes out and hires a sub contractor who ruins your house, who are you going to sue?"

You are going to sue the advertising company of course i.e. the sub-contractors! The sub-contractors may then turn around and sue their sub-sub-contractors! People are only responsible for what is in the contract!

Naturally, MS is most likely in the free and clear as it likely states whatever the sub-contractor (marketing firm) delivered should be properly licensed!

"Same logic applies here. Spike TV had a contract with MS for a trailer, MS hired a sub who botched up the job. So who is to blame in the end? "

Nice spin man!

Spike TV has little do to with this as this is an issue between advertising agency (what you call sub-contractor) and MS. MS may sue the advertising company, which in turn must fix the issue with the licensing company.

Sure its there fault I haven't seen one comment from M$ or even Turn 10 saying they're sorry we didn't know the footage was stolen from a TV show blah blah blah they knew what they had they knew what they did fanboys (not you) need to stop making up excuses for M$ smoke n mirrors campaigns

But why do they even need to take random footage from websites to advertise there new game? really must have something to hide when they cant even render a short scene
-Alpha  +   1363d ago
It was meant to tease. That doesn't mean their hiding anything. Likely they didn't have much to even show considering Forza likely wasn't even on the card and Gears was pulled. They had permission to use the video, but they seemed to have misunderstood the extent.

Right so lets flip it on its head then, for example, im bringing out a new car show and want to put an ad on tv, so i go 'borrow' some GT5 gameplay footage, but its cool coz im just 'teasing' my show

And what's wrong with that? They can make their ad whichever way they want. If they have permission to use GT then what's the big deal?

Turn 10 steal footage from... Turn 9? Something fishy is going on there chaps!
Michael-Jackson  +   1363d ago
They could have shown Forza 3 with no hud. No one will suspect a thing considering the graphics can't be improved much.

What I don't get is that while this basically lends towards MS experience and understanding in gaming, their position in the industry, people don't seem to accept the fact - that they suck as game makers.

They've been in the console making industry now for close to ten years and seem to have an inability to foster in-house talent. They chased out Bungie, ruined Rare and outright closed dev houses that use to be big on PC without ever really exploring their potential on consoles. They point to all the time they've had to develop XBL as their key success, yet pretty much try to pretend that the Xbox1 never happened. Except for Halo of course.

Lets also forget the elephant in the room: RRoD. Something that happened solely because they were more focused on market position than product quality. Why is it that when a company such as this regularly F-ups on such a grand scale - Windows Vista - that its impossible to believe that they'd flub something as simple as a commercial? Even though advertising seems to be their main strength. Especially to a point some feel they need to be defended.

This isn't about them messing up some stupid commercial. This about them calling Forza 4 "definitive" much like they did Forza 3 when both titles were only just announced. Were calling out the GT franchise when PD, who have earned their position, was simply content with making a good game for the sake of making a good game. Turn 10 meanwhile have again put themselves under the gun with MS on their back and with a commercial, which had many a brain-dead loyalist screaming it was all in-game, has them stumbling just getting into place for a race they're the only participant in.

They want to be PD, take their place in the indusrty, they need to get into making their game. Not rushing its advertisement to the point the guys making the commercial have to steal/lift footage.

The hole point of this artical it to show that ms didnt steal and it was a misunderstanding between the 2 companys.

Everyone quick to point fingers till they know the full story. But ms has done things wrong you carnt deny that but some have just been tacking to far .

All this for a teaser trailer lol

The thing is if there wasn't all of this complaining, if MS had simply been given a pass, they would be talking up this teaser trailer.

lol I have to laugh at the irony of Sony fans and norman29 to be exact bringing up GT5. Love the game, but didn't Sony steal a image of PGR for an ad? Ah yes, I remember that, lol, mistakes happen people. If Microsoft is deliberately doing this, than so is Sony, no gray areas.
