We recently had the opportunity to sit down with Marc Edelman, a professor of sports and antitrust law at Barry University's Dwayne O. Andreas School of Law.

He shared his thoughts with us regarding the recent American Needle vs. The National Football League verdict, and its potential impact on the EA Sports exclusive NFL licencing deal ...

Well this has taken a lot of time. The bottom line is, we wont see another company make an official NFL game until EA want's them too. Maybe they will realize that competition is a good thing. It's never good to become complacent. Madden sales are actually DOWN from 2005. What's that tell you?
I doubt this helps get the 2K NFL games back, but it wont hurt.

Not necessarily. A publisher could appeal the agreement by citing the ruling in the American Needle case.

the appeal would fail from what i look up this ruling involves iitems and products that have NFL logos and team trademarks . So now NFLPA for u that don't know is national football league player association can let 2k make a NFL game without NFL rights games like QB quarterback NFL BLITZ have done.

I would like to see a dev team maybe go the route of Konami with PES. They secured individual licenses from the teams themselves and provided an extensive editor for the remainder of the leagues. I just wonder if there is an owner bold enough to step up and demand his/her right to license the team!?!? It would be costly for the dev, but a point might be proven to the NFL as a whole.

The good thing is, 2K hasn't really quit making football games. They have a free to play football game somewhere on the web. Also, this new game Backbreaker isn't that bad for a first year football game.

The bad thing is, those 2 companies will probably be behind EA for a few years while they get everything together. This Madden 2011 is looking kinda good and will probably be the first Madden game that I buy day one in a while.

I would love to have 2K back, but until then.... you gotta do something!

Interesting ideas, and nice to see an interview with an Academic as opposed to someone from EA (or the like).

I would give anything to see an NFL successor to 2K5.

Interesting points made. I would actually like to have this reviewed. Since the NFL cannot act as one entity, I would like to see if this ruling would apply regarding the NFL licence.

If anything, it would be nice to bring competition to an arena that EA has essentially become a monopoly in.
