Nintendo's president Satoru Iwata said he wishes to "enhance the ability to combat piracy in Europe through both legal and technological means." He plans to achieve that by developing consoles that won't play illegal software.

It's not a "now" thing . Piracy has always been more present and far easier to do on DS than psp or iphone .

There is only a handful of really good games to buy on the DS anyways, kinda like the wii.
How many of those were downloaded and played on emulators by people who don't have a DS though, how many people would have bought them if they couldn't have gotten them for free, how many pirated it just to try it? it's impossible to put concrete numbers on piracy kids. The fact that worldwide sales are down doesn't help either, sure some if it may be due to piracy, but not all of it. European people are also the last people I think about when it comes to handhelds, not being racists but most of them I know only play on consoles/pc

I cannt go to a computer fair or mobile phone shop here in the UK without having an R4 or TT card shoved in my face. DS piracy is alot bigger than people think. And its a damn sight easier and cheaper to pirate NDS games than PSP. I've had people time and time again buy DS systems from my old shop, and could here them talk about pirating software before they reached the til. Also, just browsing several pirated websites shows how popular downloading DS games actually is.
That translation is wrong, here is what he actually said: "the decline of our software shipment in [...] the European market, we acknowledge it as a big issue because, even though the decrease in actual sales in the markets was smaller than the decrease in our shipments, the actual sales declined about 20%. Some say it is due to piracy activities made possible by devices such as Magic-Coms (e.g. the R4), but I don't believe it's the only reason." A mere 20%, plus he doesn't even think the R4 did it... 3DS in October(if true) means this won't matter for much longer. I wonder how they'll secure the 3DS, I think they might actually go with holographic media for one.
I expect none . nintendo isnt good at all when it comes to software protection . Their best protection was still the cartridge medium . Their only saving grace will be the difficulty at first to implement properly 3d on pc emu .
They'll at least have some protection like firmware updates(like with the DSi) and I'm thinking holographic is a possibility. I don't know how much it costs but it allows much higher capacities and works with normal media card slots and Nintendo (part)-owns the patent so it will be difficult to replicate. I think protection will be a high priority though and it'll be interesting how they'll approach it. I think trying to make it so you at least need a DS to play(with unique features) could be their main idea but I guess we'll see. EDIT: I think firmware updates will go a long towards it, the problem with DS piracy is that it's easy for even otherwise uneducated parents. If they can make it a hassle it'll put a lot of people off but of course won't prevent hardcore pirates. I think better implementation of their online store might help too because it will make affordable games accessible.
Is it possible that the customers aren't in fact pirating the games...but not buying them because they're crap? Like, not even playing the games at all. If a game doesn't sell well, Nintendo will blame piracy. If the game DOES sell well, Nintendo will still blame piracy for not getting enough sales.

Piracy may an issue but the tons and tons of showelware that plagues the DS as well as the Wii people get tired of!
