This has been going on for years, in GAME included. If you go into any store and buy a new game that isn't factory sealed, the chances are it's probably been used. I remember GAME trying to sell me unsealed/used Nintendo 64 and Sega Dreamcast games as new (it's been a long time since I've bought games from stores due to their high prices...). So next time a store tries to sell you a new game that isn't factory sealed, ask for a discount. And games can be resealed then sold as new, which is a common trick on eBay.
