Lawyer sues Microsoft, claims Xbox 360 causes 'destructive scratches' to discs

A lawyer from Fort Lauderdale, Florida has sued Microsoft, claiming that the Xbox 360 causes "destructive scratches" to discs.

According to the Miami Herald, the lawyer says that the laser that reads the Xbox 360 discs permanently ruins games. He is now requesting that Microsoft not only pay to fix the problem, but pay for all of the individual games ruined.

I think more people should sue over this as its another known issue, my friend has gone through around 3 copies of Gears of war as the console has cracked and badly scratched his discs and he never moves the console!!

And I think its diabolical that Microsoft even charge $20 to replace their own games when its their own machine that has caused the problem with no fault of the gamers!!

what i dont get is how some people's (including myself) 360 works perfectly fine. no rings of death no over heating , no scratching, and some dont, the people bringing up all these issues must be just plain lying. If you move the console while the disk is still spinning of course that there is a possibility that they might get scratched.

It's a proven fact that some batches of 360 were made with a disc-drive that doesn't have protective rubber pads that prevent the laser hitting the surface of the disc and scratching it. I'm am a 360 fan myself but to deny this and call it lies is just plain ignorance and fanboyism on your part.

Yes I have the crappy drive. I have a crappy launch console. And yet mine has worked perfectly from day one. No RROD. Locked up once about 6 months ago.

You know the console doesnt scratch discs if you dont knock it when it's playing. I saw my friend do it to his. His 360 was on the carpet next to his TV, then he walked past his TV while playing Oblivion and his foot just knocked it a little while it was playing. What happened? Instantly we heard the scratching sound.

Mine hasnt scratched discs because I havent disturbed it while playing.

I know some 360's were fragile, and may brick, but M$ is working on correcting the problem at least. What did SONY do after my SECOND console stopped reading discs? They said give us more CASH. What will M$ do if my 360 bricks? Send it in for FREE!!! We'll get it back to you soon!

<EDIT> @sjappie: Yea my bad. I forgot there were some that scratched by themselves. Very rare though.

Did you see the link I put up? In that video it shows it can scratch discs on its own. Even if you would disturb it by accident, it shouldn't be scratching the disc whatsoever. They should've made sure every drive had protective rubber pads.
Also, I'm still on my launch console to, without any problems and Ilove it. I don't know why you bring up that Sony/MS/service story. I wasn't bashing MS or anything, just looking out for the truth.

but only once. I returned it and all has been good. Apparently there was a problem with the early Gears DISCS because I know alot of people who had the same problem. Not sure the 360 can be blamed for that.

Thats what mine did. I bought Gears when it released. I didn't know problem was more common.

This happened to me but it happened when i moved it to my friends and i left the disc in there but it has never happend since.

well i've got a launch 360, not one scratched disk and i run it vertical also. yep.

I still got my launch 360 but the disc scratch was my thought what i said above and also i got red rings and turened my 360 off soon as i saw them, and played it later on once it called down lol i must be lucky.
