Why Suing Sony Over Killzone: Shadow Fall's "Fake 1080p" is Ridiculous

its as easy as

pay $60 for a game and because of "false advertising" i expect 5 million dollars REALLY!!!, if you are that disappointed you will go back to the store or sony directly stating why you should get a full refund and if they sony denied you that then you sue but to come out of left field and sue come on now this guy is just trying to get paid.

I hope this backfires and he has to pay the legal expenses. It's really ridiculous and it would be even more so if he gets through with it. People didn't even notice this before it was analyzed thoroughly.

i done condone any company to falsify the product or service they are selling to me but if i did find out i would approach them directly to explain my displeasure and if they just shunned my case then sue

Isn't this a Class Action suit where a large number of people with a common interest in a matter sue as a group.
Not sure if this guy is suing in order to get money out of Sony or in order to raise awareness to this particular issue.
I at least hope that publishers will receive the message that deceiving gamers with false advertisement or information is not ok.

The funny part is that nobody noticed until it was confirmed.

@disgrees: start posting some articles proving that people were aware of the problem before it was confirmed.

Even nitpicky journalists that found flaws in every other area didn't notice(speaking in general of course).

I'm not praising/defending the game btw and I'm more interested in other titles.

@HighResHero People knew something was wrong with the multiplayer resolution, since the gameplay was more blurry and less sharp than the single players. We can't confirm something officially when we never worked on the game.

The box of every Xbox 360 game said 1080p, when in reality it was upscaled 720p.

Why did no one sue?

Microsoft said that Kinect would be crucial to the Xbox One and that it was required to function and that it would guarantee developer support in order to justify their fanbase paying $100 more...
...Then we found out you didn't need it and they completely removed it. Screwing both developers and consumers.

Did anyone sue? Did developers sue?

That's what makes it super corny. Ok, he wants to sue, sue for what you paid, or like $100-$200, whatever. Once you get past that, it's obvious you're looking for an easy payday. It's gonna get thrown out automatically probably, just for how much this douche is asking for.

This is a class action suit. Everyone who bought it would get a small check. He isn't trying to get that money for himself. This is to make a statement about lying to your consumers.

It doesn't matter if it's a class action suit or not. This is a ludicrous lawsuit and nobody was lied to. It states clearly on the retail box "1080p Video Output" and in the fine print "Video Output in Full HD 1080p requires a "Native 1080p Display" This is a play on words that won't hold up now matter how it's spun.

Where were all the lawsuits last generation when one the back of most X360 retail boxes 1080p is written when nearly every game was below 720 and upscaled to 1080p?

Come on man. This is nonsense. Plain and simple.

Why the hell not? It's not about whether the suit is won but nobody wants to pay legal fees so the threat of law suits is what ultimately keeps them in check.

That's a great point.
Just look at all the early adopters of the XBOX ONE (me being one of them) being flat out lied to. Also all their other policies that Major Nelson and the boys said can't be undone.

Come on guys. Regardless if you're a fan of one console or a fan of them all? This lawsuit is flat out nonsense. It's bullsh!t like this as to why we have to go through all those nonsensical read and click accept terms before proceeding. Why would anyone justify this nonsense boggles my mind.

Parsing words and terminology will only make things more restrictive for us all. I'm tired of thumbing through the fine print. Money wasted fighting a BS suit vs investing in more games hurts the industry.

These guys bringing forth this suit are aholes and their lawyers give lawyers a bad name. If that's even possible. Nothing but parasites. Not that it matters. This will be shot down and they wont get a cent.

Can anyone produce a link where Sony said that Killzone's multiplayer was native 1080p? I'm not interested in what all of the fanboys are going to obviously say on either side; either there's proof of Sony advertising native 1080p mp, or there isn't.

Downgrading MP graphics for extra smooth gameplay is hardly a new or rare practice, so let's not kid ourselves with claiming that Sony mentioning 1080p in KZ is enough to call them liars.

Yeah it came from Sony's PR guy Sid Shuman back on November 3rd on the Playstation Blog, "Then there's the competitive multiplayer mode which runs at native 1080p and 60fps."

That being said I agree, I think this is all completely unnecessary and waste of time.

Yeah you can go to killzone site are saying that because they use something called temporal reprojection the image is reconstructed into
full 1080p in multiplayer mode.

edit: oh this came out in March. I really wasn't looking for a post-launch clarification link.

I want to see a link that shows that they advertised **native 1080p MP** WITHOUT the clarification. They clearly explain everything in detail in that link; no one can walk away from reading that claiming that they had been deceived.

Can't be bothered to find links, but they definitely exist. In fact the dev even continued to claim it is native 1080p in an official response when they were called out on it.

It was a bit naughty, especially when you consider the "unfair competition" aspect of the class action. What with the whole "resolutiongate" being leveraged at the time.

THANK you. F***ing finally. All I asked for was for someone that was more than certain about the situation to share a link (that WAS my research; better to ask people who already have links than google blindly).

There's no clarification in that link until a small March update. Pretty definitive; there was false advertisement.

It wasn't like the information was hidden deep within the bowels of the internet, all you had to was type "killzone + mp + native + 1080p" and you would have answered your own question.

in order to attain 5million it would have to be a class action law suit. Then, the 5m would be split up among the thousands of people that had bought the game (each person might get like $10-30)

The reason i think it's ridiculous is because it might force devs to not even try for 1080p in fear of "promising" 1080p, not hitting it, getting sued for false advertising.

It's because Sony lied. if Sony lied folks have the right. No one is talking about 1080p upscaling from a lower resolution listed on a box. This is different, Sony made public PR statements saying a game is 1080p throughout and it's not.

Listing a max resolution for a game on the back of box(hardware enabled or not) is not the same thing as telling consumers a flat out lie about a spec explained in detail.
