Sony Cracking Down On Ellen Page Pictures, Lawsuit Inbound?

Eskimo Press: "Sony Computer Entertainment is requesting that all leaked nude images of Ellen Page to be removed. Does this mean that Ms. Page is very unhappy with the leak? Lawsuit incoming, perhaps?"

Update: Confirmed that images requested and related to be removed for "Legal Reasons". Ellen Page is most likely threatening Sony/Quantic Dream with a lawsuit.

If it was "leaked by a reviewer on a devkit" can't she go after that reviewer for personal damages?

Does anybody have a legal background or can someone offer some context here? Aren't reviewers under some kind or orders when it comes to this thing. If she did the motion cap for the shower scene, she must have been aware of this content in its totality.

No because he posted a image of a rendering of her body, its not her real body in such case she should have to sue Quantic Dreams for damaging her image.

Totally agree, seems like N4G got a bit to quick with its continual anti-Sony news (what even has quantic dream to do with that since they didnt even posted it ?)

Btw, these seems devkit image, which have been removed from the final product i think

What does Quantic Dream have to do with it? Gee, I don't know, they just sat there developing nipples and vaginal lips and even did a pretty intense job at it. Oh yeah guys, they have NOTHING to do with it right?

Give me a break. Debugger was a jerk sure, but he didn't create nipples just by changing a camera angle! You can view other camera angles in some DVD's, doesn't make the guy with a remote control a criminal...

i don't understand why she is soo special that everyone has to use her likeness ive seen wayy hotter girls and shes an average actress so why is she getting so many offers to use her likeness

A law student's opinion:

She likely retains the rights to her likeness - at least beyond what is presented in the game. Having not played it myself, I don't know how much nudity (if any) is actually shown while she is in that shower. The game developers are likely liable for any nudity of her likeness beyond what she agreed to have shown in the final retail version of the game.

So if what we see in the nude shots on the internet is more than we see in the game, she would be able to sue them on the basis of breach of contract for misuse of her likeness, possibly defamation and other claims as well. Simply put, the developers are liable for what happens with code they created if one could have reasonably foreseen someone gaining access to it. And in this day and age of technology, that's not a very hard thing to prove.

EDIT: It would be like leaving behind-the-scenes footage of a shower scene as a file on a DVD. In the movie, not much is shown. Behind the scenes... as Pervy Patrick Stewart would put it... I've seen everything.

Thank you for your insight. I have another question. A lot of times, reviewers are bound by what information they can reveal about the title. This includes what material they can and can't reveal or distribute. If this is the cause, could Quantic subrogate against the reviewer?

lol, Witherspoon? She had Legally Blonde and a few other movies YEARS ago, Page is more popular than her right now. Who's A-List or not doesn't really matter, it's not like they're doing anything important like saving lives.

Reese Witherspoon, Halle Berry, Charlize Theron and Sandra Bullock

ALL are usually the Main Characters in their movies (except ensemble movies)

ALL have been the Star of a Movie with a bunch of no name actors and have carried the movie to financial success.

ALL have WON an OSCAR! Hollywood's Highest and most coveted award that ALL Actors wanna win.

Ellen Page has a LONG way to go before she is considered A-List. I think Ellen Page can act but she is NOT A-List!

Just because she didn't win the oscar she was nominated for doesn't make her any less of an a-lister than any of the other actresses you posted.A-list status depends on the actors you know.Its no universal fact or something.

Have you SEEN Halle Berry? She's hotter than that whole list today and she's almost 50.

I have seen Reese in a while (she is probably off having kids), Halle, Charlize, and Sandra, have all been in the acting game for a long time and are still in it. All have had big-time success AFTER their young hotness has worn off (emphasis on "young").

Not to mention that as A Ti_Elite said, they've all won Oscars. Winning an Oscar = big time actor or actress.

I thought Ellen Page was more of a comedian than a actress.

You are way out of touch if you think that Ellen Page is not "A-List"... Page has won more than 30 awards, and was nominated for the Academy Award for Best Actress, a Golden Globe Award, and a BAFTA for Juno.

Ellen Page is a good actress no doubt, but aside from Inception in 2010 and then this game she has kinda been on the back burner for a while doing some smaller or independent movies..

Juno was a fun, cute movie, but Hard Candy is a much better display of her acting ability. But both of those movies were from 2005 and 2007.

She does have a role in the upcoming X-Men movie, however I don't pretend to imagine that she's a huge presence next to all those other major actors.

Let's not elevate her status above what it should be...

Who defines what makes an "A-list" Actress? you?
While I like some of Charlize and Sandra work, they have terrible movies too.
Yet you fail to mention names such as Rachel Weisz, Susan Sarandon or further back: Audrey Hepburn.
IMO Ellen Page did great in movies such as Hard Candy.

Personally I don't care for your definition of "A-list". Judging from the number of disagrees you've gotten neither do many others.

Basically about a week ago someone with a devkit version of the game found out that can freely move the camera around whenever you want. So they moved the camera around during the scene where Jodie is taking a shower and took screenshots of Jodie naked. These images were than posted online and now Ellen Page, whom Jodie is modeled very very closely off of, is upset saying these naked photos are casting a bad image of her and she wants them removed.

first a terrible game with low reviews now this? have fun sony? blame david cage trying to be hip using nudity just to be controversial. next time make a actual game and not to watch.

This sounds like litigation, to tell you the truth. It seems like an oversight on Quantic Dream's part to make nude models of the character, for whatever "realism" reasons they had, and then expect those models not to be exploited later on - as we saw with Hot Coffee, if it's on the disk, it's fair game.

Chances are QD's contract didn't include the disclosure of a nude body, and now they're trying to backtrack through Sony by having them ask everyone to put Jodie's clothes back on. It's like they never saw what happened to the original Tomb Raider - and that took a lot more effort because assets were actually generated for that. Because it probably wasn't directly in the contract, they're in a fuzzy and weird dispute with an actress with a ton of money and legal counsel.

I'm guessing Sony isn't happy about any of this, including Quantic Dream's oversight.

Ellen chose the wrong game. She should have rolled with Naughty Dog and The Last of Us.

When Naughty released the first video of TLoU, the girl looked JUST like Ellen Page. People were speculating that she was going to be in it. I believe that there was more to that than what was reported. ND had to know that was Ellen's likeness. I believe that they tried to get her for TLoU and that she chose Beyond Two Souls over them.

You do realize that many good actors and actresses choose projects they like and respect.

None of us know if she was offered TLOU. What we do know is Ellen Page jumped at the chance to be in Beyond after reading the script.

If $$$$ is everything then CoD is the best game eva. While I like CoD, and buy it every year, it simply is not the best game eva.

$$$ doesn't make anything, it only obscures reality. Have you ever noticed they don't go by 'ticket sales' in hollywood.

If they did you'd find out that the most watched movies came out decades ago with the country half its size.

Who knows who is behind this. It's a bit of an overreaction. Maybe it's just QD and Sony trying to prevent a lawsuit by being proactive. Who knows.
