Motorola fails to win Xbox ban in US and Germany

A US judge has ruled that Google's Motorola unit cannot ban sales of Microsoft's Xbox 360 games console because of a patent dispute.

I don't think it would make much of a difference at this point in its lifecycle even if it was banned. MS has sold millions upon millions of consoles and it's still selling well. Plus, the new one is about to release next year most likely so it wouldn't hurt MS too much if they did have the 360's sales banned.

Also, important to note is that Microsoft probably has a lot better lawyers than Motorola. haha $$$ talks.

I do hope both the PS4 and 720 come out next year though.

Motorola do ask for money for each sale at a ridiculous 2.25% of retail price.

Other FRAND patents are licensed at fractions of cents while Motorola wants at least $10 per Xbox 360 sold even though their patents are included into standards because they pledge fair and reasonable licensing costs.

It's like I promise you fairness so you make it an essential part, then I turn around and make it unfair!

If Apple was suing, they'd be banned today and off the shelves tomorrow. But Apple doesn't create any new patents, so that'll never happen. Just hypothetical.

But still, the price they're asking per xbox isn't ridiculous. Microsoft should pay it.

They're asking for $4 Billion in FRAND PATANTS, that's like me charging you $100,000 for a pack of cigarettes, it's ludicrous.

4 Billion/70 Million=about 58 dollars per xbox. But since it also spans to the Windows OS for using it too. When you factor that in, Motorola is only suing for....wait for it...

4 Billion/370 Million=only $11 per device in all actuality. I think it's safe to say they have the money and it's not ludicrous, considering how much an Xbox and Windows cost. It's punishment for stealing and using it in a profiting device. 2x the normal (Not ludicrous, but fair) licensing fee as punishment for stealing it without paying loyalties sounds about right to me.

They did it themselves. They could have just paid the 2.25% per Xbox for the license. Their fault. They need to be punished since they won't remove it from their services. Pay up.

When you're licensing the same technology to other companies for a few cents, and then demanding that another company pay $11, well over a 1000% increase, that violates fair trade laws, there's no two ways about it.

Microsoft has said from the beginning that they would pay for the technology, but they certainly don't have to pay whatever Motorola wants... it doesn't work that way...

They'll probably settle somewhere in the realm of 50 million. THAT would be fair.

Teach MS a lesson. I don't hide the fact that I dislike MS. And before the gaming fanboys go ballistic, I grew up with microsoft in my life. My dislike for their business practices and how it actually hinders competition and progress has been an issue with me since Windows Millenium.

Had no opinions on the xbox, thought xbox would appeal to me, a friend and I were hooked on the first halo's co op but then the news of power cord recalls due to fires and rrod and my disc scratching that the 360 caused that ms would not replace unless it was published by Microsoft also pissed me off.
