Killer Instinct trademark application by Microsoft refused by USPTO

Killer Instinct is a Microsoft intellectual property but the trademark application for that has been rejected by the USPTO (The United States Patent and Trademark Office). (Industry, Killer Instinct, Xbox 360)

Yeah but it was earlier owned by Nintendo though. I think since they are both in Entertainment section, Microsoft didn't get it.

They should probably give it to Microsoft though considering it's a video game IP.
