After all companies don't make the games awesome it's the creative people that lead the team that do that. A company name is just a company name.
You’re right, Microsoft owns Rare, but there’s no problem if this company decides to make a game for the 3ds, because Microsoft is not in the handheld industry.

Its all about making money. Sony owns the Spiderman ip, yet Activsion (not sure if they still even own it) make the Spiderman games. PS3 uses a lot of MS programs and features, MS on there video section on XBL has Sony owned movies.
They are not bitter enemies. This is just business. Rare did a few DS games too.

Microsoft would never part with Rare, because it owns all the IP's, and that is what they really paid for.
Rare did a Viva Pinata game on the original DS, and that was while Microsoft owned them. Microsoft doesn't see competition from PC or handheld's.
