I don't think they have to go, but they can't be so vague and general, like all of those patent trolls with patents for "two way communication" or whatever.
The problem would be to decide what is vague and general. I think it is quite a significant task to determine that. If done well, software patents could still be fine. But I don't think there's a way to clearly define what is vague and obvious.
I think it's worth trial and error over banning software patents. Society already has little respect for software rights, and getting rid of software patents entirely would make your ability to protect your software creations VERY difficult.
I'm pretty hardcore patriotic, but when it comes to the power and frivolity of big business in this country, I don't really blame ANYONE for their frustration.
