ITC delays Microsoft Xbox 360 US import ban decision

Neowin: "A decision on whether or not Microsoft's Xbox 360 game console should be banned from being imported into the US has been delayed. Reuters reports that the full panel of the US International Trade Commission has sent the case back to its judge for reconsideration. That could put off a decision in the case by months." (Microsoft, Xbox 360)

US House of Representatives member Darrell Issa (R-CA) also wrote his own letter to the ITC supporting Microsoft, saying, "An exclusion order would eliminate the only U.S. based videogame console from a market."
We had a games console for many years without one coming from the U.S. and we did fine.

He's supporting the U.S market and it would definitely hurt if it got banned and we DEFINITELY dont want that to happen right now for the economy's sake.

True they are made in china but i dont see the irony. Xbox gets banned in the US this means that all sales of the 360 halt. Hence retailers miss out on sales which which results in MS being unable sell stock to retailers which will result in job loses for MS and retailers.

Thats what im trying to get at!

I can't say that I want XBOX 360's banned,
But surely you see the irony of your "economy's sake" statement, when the XBOX 360's are really made in China.

Yes i agree George Bush and the way Bankers were given "immunity" are some of the main factors into the problems we have today... But i dont understand what your comment is saying.

Yeah this caused the economy to collapse but you've typed in a sentence but actually said nothing...

What im trying to say is this ban would really hurt good people in America who have a job within MS's Entertainment division and anything associated with it. Publishers, devs and anyone who makes games for the console all of a sudden have a capped number of sales that's possible for their game in the US.

Seriously Forget the fanboy crap that this news brings. Think about how you would feel if you lost your job in a world where its so hard to find a secure one.

So Apple get to ban sales of Samsung galaxy tab. But when it comes to an American infringement the rules change?

That's fair.

But Americans have NEVER played by the rules.

Look at the fuss they made over the BP oil spill. Whenever American companies did EXACTLY the same elsewhere...they NEVER even offered to pay for the clean up.

Well that's good, the system doesn't need a ban on being sold. Though I do think Microsoft needs to pay up in some way or another, just not a way that hurts consumers who like the system.

Well, when one of the biggest companies who puts some of the largest amounts of money towards marketing on every single channel and publication out there talks, you listen.

But, honestly, Motorola is kind of pushing Microsoft on this issue. I'm not wholy informed on the topic, but I'm not sure why they are asking for a different price on the same patent for use on the 360 as opposed to other devices.

So apparently according to some of the comments I see here:

1. The 360 should not be banned from import even though they are breaking the patent agreement by refusing to pay for them. (They could just make them here, thus creating jobs and avoiding lost sales, but that would cost too much money compared to lawyer fees and the patent cost they failed to pay in the first place.)

2. The sales of Xbox 360s are one of the few pillars propping up the fragile US economy. (Really?)

3. MS should get away with not paying Motorola for using patented technology in their systems because some people like playing Xbox 360. (If Sony or Nintendo were doing this I would still think the same way about it, the law is the law. I don't care if I do own a Wii and a PS3.)

MS could have avoided this whole mess by either just paying for the patents or developing their own method for whatever the patented technology did. Sony had to do that and so did Nintendo due to patents that are held by other companies, including MS. Or does everyone think Sony should just add cross game chat in the PS3 and not pay MS for the patent they own for it?

sony and nintendo went through this exact kinda thing and they had to dish out money if wrong, i remember the ps3 even had a halt of sales until after ruling. stop defending whats wrong people, microsoft has to either pay or the xbox sales halt because thier is a ps3 and wii on the market is more reason for the judge to rule in favour of google they do the same things the 360 dose.

I don't even pretend like I have an idea about all these patent wars. To me, this is the cancer of an industry.

I do know though that something smells fishy when Intel, Activison and even APPLE (!!!) support MS for this one.

I am against a ban of any console and you have to be a fool to think otherwise.

The Xbox 360 is on the market for 7 years now and suddenly Motorola notices, after they were bought by Google, there are patents used in it and it should be banned. This is just bizarre to me.

Same thing a couple of years ago with LG and PS3.

But when Apple supports MS, you know it is not okay.

Ahem, MS have already since long ago clarified that they want to pay moto the licensing fees. But that isn't the problem. MS said they'll pay, but then Moto comes out saying that they want to charge MS an annual $4bn for the fees. They're basically singling out microsoft for whatever reason for a FRAND patent. Where's the fairness in charging company X $0.05 per unit for the tech and charging company Y (microsoft) much more by a significant margin? The h.264 is an industry standard patent meant to be licensed similarly at low costs. So, you tell me. Is it reasonable for any company to pay an annual $4bn for the tech?
