Manuel Noriega genuinely suing Activision over "unlawful exploitation" in Call of Duty: Black Ops 2

There are some stories which are just so bizarre and fascinating that you can't help but laugh. Former Panamanian dictator Manuel Noriega has launched a lawsuit against Activision accusing them of unlawfully using his likeness in Call of Duty: Black Ops 2.

Noriega says Activision portrayed him as the "culprit of numerous fictional heinous crimes", and accuses them of "misuse (of his image), unlawful exploitation and misappropriation for economic gain".

Oh brother.. Greedy people trying to gets chunk of the money... I guess I'll sue Ubisoft for having a character of me rendered from my Facebook profile into the game on Watch_Dogs.

If you don't know who Manuel Noriega is, at least read the article.

Noriega was one of those South American dictators from back in the day. He's got his own heinous crimes to own up to, without being saddled with fictitious ones. Hell, that was literally in the very first sentence of the article.

That said, I think being a public figure pretty much means he no longer has control over his "image." If so, things like political cartoons/caricatures wouldn't exist.

Well.....Noriega was actually a North American dictator.....not South American. Panama is the southern most country in the continent of North America. Central America is not recognized as a continent.

Really? Have you been subject to the new Common Core? Central America has always been noted as Central America. He was not a NA dictator...that title is reserved for those in Washington who are trying to undermine our United States.

Re-read what I wrote. All I said is that Central America is not a continent.....it never has been, though your common core comment is quite funny. Central America is a region within North America. So yes Noreiga was technically a North American dictator. What I don't find funny is the comparison of elected Washington officials to this dictator. I don't always love Washington politics, but I will take them everyday of the week over the fear and violence that Noriega used to gain and keep power. If you are American, be proud that our system of government generally works....provides for the common defense and the pursuit of life, liberty and happiness.

Difference between you have him is his life (although evil and horrible of an existence as it was) was an actual dictator. You AGREED to allow Ubisoft to put your facebook profile onto Watchdogs...

Anyway, why does he suddenly care about this now when 2 Call of Duty games will be out by the time (if it does actually) go to court? Seriously, cry moar!

Manuel should keep a low profile before the U.S.A. decides to send another Spec-Ops team to Panama and this time I'm sure they will "GO LOUD" and take NO PRISONERS!

I guess it depends where he is suing, in the U.S. there is a law that says you cannot profit from your own crimes so criminals don't have rights to make money when their likeness is used in movies and stuff

It depends.

He technically isn't suing because they portrayed him in the game, he is suing because of how they portrayed him in the game. Basically, he wants to sue because the game portrayed him as a bad person. The fact that he was portrayed isn't the important part of the claim, it's how they did it.

You may think I'm splitting hairs but this is what a decent attorney would say to get around that law. Some judges will actually allow this.

They'll try to make it seem like he is trying to protect his image instead of trying to profit from the his portrayal.

I think it's BS and this guy ruined his own image. If he was worried about how people would portray him, he shouldn't have done the things he did.

dunno but the only way to picture a reallife person in a creative way is through satire or humor, if you go into a realistic storytelling it get difficult.

It has to be obvious that your "world" or story is fictional,if not you will get into trouble.

you cant use "random politician, artist, public person" into a realistic consense and make him do thing the realworl person doesnt feel comfortable with.

Even if he was/is a criminal he should be alowed to use the same laws as everyone else and also have the same rights. everything else wouldnt be the democracy i hope we all believe in.

This is highly unlikely to go anywhere. There are laws against exploiting someones name or likeness without permission, but this situation likely doesnt fit the bill. Its also unlikely Noriega would meet his burden of proof for the required elements of an exploitation of name or likeness action.

There are first amendment protections for creative works. In other words, the First Amendment ordinarily protects you if you use someone's name or likeness to create something new that is recognizably your own, rather than something that just evokes and blatantly exploits the person's identity.

But hey, good luck with the law suit. Might as well give it a shot before the statute of limitations is up, right?

As dumb as it sounds, I actually agree with old Manuel here. I guess they figured it does fall under the public/political figure for purposes of parody or satire? I don't see any parody or satire going on in these games, so that would be a pretty thin argument, I think. All I see are false representations of him, or at least his likeness, doing things he never did and it amounts to little more than defamation. Noriega doesn't need any help with defaming his character. Developers have done the same for other public political figures, too, like Abe Lincoln, Napoleon, etc., in other games such as Civilization and many others. Didn't the old NBA Jamz games have some presidents in there too? At least NBA Jamz has a legitimate parody claim.

Well regardless of exclusives, or whatever else there is to play on Xbox or ps, CoD has has still been the top selling game on ps platform since forever also.....so no surprise that the most popular game franchise on any console could easily have a revival due to servers coming back online...this is just credit to xbox backwards compatibility & thats good thing for Xbox gamers.

Unreal Tournament and Quake III were simply amazing ... CoD's and CoD-likes' rise killed the arena shooter popularity ...
Unreal Tournament 2004 is my favorite in the series.
Didn't enjoy Unreal Tournament III, Quake Champions that much.
Too bad Epic cancelled Unreal Tournament 2014 becoz of Fortnite

I agree it’s worthy at the start of the generation when there’s few new generation games but halfway through the generation it’s not a feature.
Now it’s good that this game is finding a renewed life for its fan but it shows a mayor flaw in new games release when a close decade old game is toppling the charts

I don't know if I understand what you mean. It's a feature regardless of the time into the generation.

Let's take Armored Core 6 for example. Let's say I'm interested in checking out the previous Armored Core games, sure would be nice if I could play them on my current-gen console.

We're about 3 years into current-gen and old games are hitting in the top 5 for sales charts in the month.

I do get where you're coming from with older games possibly being better than the newer games, but the feature stays the feature. I can only speak for myself, but when there's a lull in game releases or nothing great is out, I like to go back to old titles. It's just nice to not have to have a bunch of consoles out to do so.

I think moving forward it'll be less and less of an issue as like with the PS5 you can access most all of the PS4 games, but I like going back to PS1 and PS2. Would be awesome to kind of make backwards compatibility a prioritized feature moving forward. Hell, Sony was the first to implement it.
