Also, I'm unclear as to why Dillinger is upset? He should be collecting royalties from 2 decades of producing and guest starring on tracks. Rockstar offered him $4,200 for the two tracks, which tells me they were trying to purchase the mechanical rights to the songs (when anyone buys "mechanical rights" of a song, they are buying the right to use that song however they want, without having to pay a royalty fee per play)

You never heard of Tha Dogg Pound or DeathRow Records? Daz was a decent rapper and a really good producer. He has produced songs for Snoop Dogg, Tupac, Too Short, and a whole host of other rappers. If you turn on the West Coast Classics station on GTA you will here a few songs produced by Daz. If they were to use my songs or songs I produced I would want to get paid too.

There is no such thing as a "license" in music rights management. Its called "mechanical rights", and the ONLY way to acquire the mechanical rights to a piece of music is to PUBLISH said music under your name with a major publishing company, or to PURCHASE the mechanical rights to an already published song, therefore allowing you or your agents/company to use it in your own commercial entities (which is what R* would've had to do for ALL the songs in the game).

If Common and Talib Kweli each do a verse on a song that appears on Freeway's album, then best believe each of those artists will own a percentage of the rights to that song and thus are entitled to royalties to it. This does not entitle the producer to any amount of profit frmo said music until his name is on a share of the published rights. So if Snoop, Dre, and Kurupt did a song produced by Sug Knight, They would have to publish it with all of their names on the publishing contract with explicit percentages as to who earns what percent of royalties from use of the song. Sometimes the percentage is divided evenly, sometimes the artist that writes and arranges the music or lyrics gets the bigger share.

Secondly, When a major corporation wants to use a piece of music unconditionally and however they want, they must purchase the mechanical rights from the publisher and/or artists. Once they purchase the mechanical rights, they can use that music anywhere for an unlimited period of time.

Radio stations do pay royalties to the artists through either ASCAP or BMI (yes there ARE only 2 major publishing companies, at least in the US). Before an album or track is released, the artist, producer, and songwriters decide what percentage of royalties will go to who, and then publish the song through ASACAP or BMI.

The producer cannot do "whatever he wants" as he will only legally own a portion of the precentage of royalties assigned to him, through the publishing contract. Radio stations, advertisements, TV shows, or whereever that music is used send data on how often that song is played to the publisher, then the publisher distributes royalty checks to artists.

I know all this because I've done it before in bands I've recorded albums with. Its not a great way of doing things, but it's literally how it's done from every artist from the unknown locals to pop superstars.

Especially considering that those songs are played over the in game radio every once in a while, and many people who play the game may never even hear it. I'd also say that it actually might be a decent advertisement for the artist.

Brian Wilson was the sound behind the Beach Boys among others, his music on Pet Sounds was a standard that even the Beatles judged themselves by. Phil Spector was the one who gave the Beatles their sound, along with Lennon and McCartney. Spector also worked with names like the Ramones, Tina Turner, and the Righteous Brothers.

Rick Ruben is a fucking legend, who produced for Aerosmith, Tom Petty, Metallica, AC/DC, Black Sabbath, Rage Against The Machine.... oh, and he helped co-found a little label called Def Jam, producing for the Beastie Boys, LL Cool J, Run-DMC, and Public Enemy.

Butch Vig? You can thank him for grunge music, having produced Nirvana, Smashing Pumpkins, Sonic Youth, Foo Fighters, and he was part of a little band called Garbage.

Quincy Jones and Babyface were responsible for some of the best R&B before R.Kelly got hip-hop involved with it.

And Barry Gordy WAS Motown.

I know everyone is losing their minds over this, but not everyone knows who Daz Dillinger is. Hell, I don't know who he is. Of course, my taste in music wasn't and isn't the same as everyone else's. So if I get disagreed for not knowing one single person in the music industry or get the reaction of "how could you not know who he is", then my only defense is I didn't listen to rap growing up or even now. I can respect that there was good rap in the 90s, but I still have no clue who this guy is.

On topic: You can't go off of one person's word alone. Just because Daz Dillinger is claiming that Rockstar used his music without permission doesn't mean it's true. We are yet to hear from the company he worked with to produce the songs and Rockstar as well. I'm very sure that there are other people who worked on those same songs as well given that music produced is never a one man show and that there are multiple persons involved. Also, demanding the recalling or destruction of a product just because you didn't like what was offered to you is completely unreasonable and ridiculous.

By LAW he did not give rockstar permission to use his songs so by LAW they should not be in the game. All game companies have a legal department who should have followed up on the situation with an easy step.

The legal department has a list of approved songs, they give said list to QA and QA runs a checklist. Time consuming? O'yes but it's what QA is there for. Rockstar essentially stole his music, doesn't matter how you look at it, it's theft. Do I know of Daz? Yes. Do I care for his music? No. But for an industry where theft is always the excuse to exercise outrages DRM policies, gaming companies should really be way more careful when using other people's work. Even as an oversight I see this costing rockstar more than the $4,000 they offered in the first place.

So many people are so ignorant and think R* can do anything and that this guy is an idiot. Let me tell you guys, if the case is the way he says then he has the right to sue them if he wanted to. Also if he says the tracks are his, then they are. Very often the producers still own the tracks, it all depends on the agreement the artists made.

The game is amazing, so is R*, but they should give everyone their fare share for when they use other peoples content and pay them a fair amount of money. I bet Rihanna or Phil Collins got a better deal. Also reminds me of Niko's actor complaining about what he got for his work, but there the case was different, but still.

Edit: And it's funny how a lot of people here say that he is unknown and that he's just a small fish. He is pretty well known for the stuff he did in the 90s and he would not be on the West Coast Classics station if his tracks would not be considered some of the best in the 90s Hip-Hop.

Just watch the credits of the game and you'll know that rockstar instead paid sony music & columbia for the right to use the music.

Yeah well, because that's the major label that he's singed to, but (almost) every artist is singed to a label (from indie to major), but that does not mean that the label get's paid. The get a certain percentage, but not everything and if the artist holds the rights to the recordings he can still choose if and for what price someone can use it, and the label does all the paperwork and licensing.

But if you are correct and Sony did make a mistake and allowed R* to use the song without them being allowed to conclude the deal, then both SME and R* would have a problem. Didn't something similar happen with Lionel Richie in GTA VC where they've had some licensing issues? Song was on the original release, then cut, but then again on the OST. The music business is weird and tbh, idc, I just continue to play the game.
