You are using a Straw Man Argument. A straw man uses an informal fallacy based on misrepresentation of an opponent's position. To "attack a straw man" is to create the illusion of having refuted a proposition by replacing it with a superficially similar yet unequivalent proposition (the "straw man"), and to refute it, without ever having actually refuted the original position.

Your comment simply does not refute what I said and does not address the issue in any way. First, your comment mentions "second hand games sales". Second hand game sales are completely different than torrents. When you LEGALLY purchase a game, I personally believe that it is your property and you should be allowed to sell it. A torrent was never yours to distribute in the first place as it is not a LEGAL copy of a game (or other media). It is a one-to-one proposition. If you purchase one copy of a game, that one copy is in the stream of commerce and (in my opinion) should be allowed to be redistributed. A torrent creates many many digital copies of a piece of media and is distributed by people who never had rights to the media in the first place.

Second,libraries simply allow you to borrow certain media. You do not keep those items. You have the right to use an existing copy of something. At some point, the publisher/developer gets paid for that copy, or they donate its use for the library. Under U.S. copyright law, libraries are also permitted to make reproductions of copyrighted works for preservation and replacement purposes. In terms of pure digital lending (which some libraries now allow you to do with ebooks), libraries can only lend e-books at the pleasure of publishers and not through any legal right. Again, this is the publisher allowing the lending of the digital only media.

A torrent, by its very nature, takes all of the rights of the original copyright holder away. Games (and other media) are created to make money. Bottom line. Yes, we would hope that those in the industry love what they do and love gaming and gamers and innovation (not looking at you Bobby Kotick), but no one wants their work stolen and distributed around their back. It costs money to create these things and most games still lose money or barely break even... By taking away the ability to make back, even a small percentage of that money, torrents stifle innovation and create an environment in which people are concerned (and rightly so) about digital theft.

So, in response your original straw man argument... You are simply wrong about my position.

Studies actually show that people torrenting material increases sales in the long run. Music, TV, Comics. All have been shown to sell better if people can try them for free first.

Now I doubt people will buy a Netflix account because of this single show, but they may buy it on blu-ray or DVD one day.

No they don't. There is absolutely no data to prove that piracy increases sales just as there is no data to prove that piracy takes money away from producers. Neither can be proven or has been proven. Any studies you've read that say as such are made up and do not utilize actual data in them that would allow them to make such an argument a credible one.

Second hand = One sale for EVERY copy.
Library = government lending with academic intent, one sale for EVERY copy.
Renting = special contracts

Piracy, however = one sale total no matter how many simultaneous owners of a copy. Sometimes zero sales the way that the game is leaked before release.

Time to stop the smug, self-serving, logic-less "piracy A-OK" crap.
Piracy is not....I repeat... NOOOOOOOOT equivalent to 2nd hand, libraries, renting, etc.

With that kind of thinking, with a MS exec on Netflix's board as well, who setup the deal which first made it exclusive to the 360, they would have products from their competition off the show.

Technically, the PS Vita isn't a real competitor to MS. No more than a smart phone is a competitor to the Xbox 360.

MS also produces software for Android/iOS.

I think if anything, it is Netflix trying to stir up some Netlfix usage on the PS Vita. The vast majority probably find the smart phone more convenient.

Well, of COURSE the Vita isn't a "real" competitor: it's just one device. The iPhone isn't a competitor to Microsoft, either.

Sony and Apple, however, who produce the Vita and iPhone, ARE REAL competitors.

The Vita's Netflix app, by the way, is pretty darn good. Never used it on a phone, so I dunno about that, but it's extremely easy to use on Vita.

@hicken, actually the ipood is a competitor to MS. Remember the Zune? (LOL) Plus Windows phone is in direct competition with the Ipoods and ipood phones. I'm sure they also use tablets on the show, do they use the Windows tablet? Sony Xperia tablets? Apple Poop Tablets?

Vita itself isn't direct competition because MS hasn't entered that market directly, however the rest of it has MS products somewhere. He even plays PS3 instead of 360.

However the show is being co funded by Sony, their TV division is partnered with Netflix to distribute it. http://www.deadline.com/201...

I was going to make a thread about this. It was crazy awesome to see Spacey ask if it was a P S Vita lol. Classic shit. It's also. Funny to a " congressman" gaming out on a fps. Matter of fact the whole show is awesome. I already finished the season. One of the best shows ever.

Yea Sony obviously ponied up a lot of cash for that but everyone else does it. I see iPads also and I remember the Kinect in plenty of shows. Product placement is a good way to pique interest. Imagine all those people googling P S Vita and finding out about it.

Look, Im not making any judgement calls about this guy, but I will say that Helldivers 2 GaaS model is unique to Helldivers, and legit the only other game I can think of thats similiar was the Avengers game except HD2 pass is still better.
The fact that you can earn in game currency in a way that doesnt make you feel like you have to grind forever, as well you being able work on that pass that you bought...on your own time without a time limit...that right there is fucking huge to me, and I can't name any game other than avengers that avoided trapping players with FOMO logic...I think GaaS on HD2 shouldn't be compared to the rest of the industry...it should be copied.

I'm perfectly fine with the way Nintendo entered the mobile market, I never touched their mobile games, meanwhile, the console/handheld stayed the way it is. As for being a bean counter, he's probably going to reel in these massive budgets that Sony's studios have had lately, I haven't played Spiderman 2, but I cannot see how they almost tripled the budget for that game.

That's an exception to the rule, I'm expecting a lot of these GAAS games from Sony to fail, to be fair, they only need a few to succeed, but I would have preferred that they put more of their resources into other types of games.

I don't think that will happen based on how things worked out at Naughty Dog now that we know what we do, seems they had the option to fully commit to live service games or stay making single player experences so they gave up on their live service game. We are not sure how things came about with Bend making a live service game but I hope that was not a forced situation. Sony doesnt seem like they are forcing studios to switch up but we will see, Sony's bread and butter is single player games it is how they dominated the console market.

Yeah, I though Sony learned something from all their failures in the LS segment under Bungie´s disastrous leadership and supervision which led to games been cancelled, studios closed and all the people laid off.

Looks like Bungie still plays a major role in Sony´s LS initiative and Sony is not backtracking on their GaaS plans.

Personally, I see no problem with Sony also having service games as long as they make good ones, and more importantly they deliver the AAA story driven games that they are known for. So yeah, I agree 100% with you.

Honestly, what’s to learn from? How to make people happily continuously dump money into a single game over its life-time? Buy season passes continuously for several years with a smile on our faces?

GaaS is a design decision that is everything wrong with this industry. The fact that Helldivers 2 did so well and people defend the monetization because it was $40 and is a fun game, scares the sh*t out of me to see that the door is open and all shift will probably be to replicate that in future games. We already know the ROI for traditional game dev cost isn’t doing it for them.

I thought with Jimbo leaving we’d see a change for the better… I’m not so sure now.

Service games are being offered by everyone. Sony cannot afford to only create single player AAA games. No one can. They already said they will be doing both.

Ps5 gamers in 2023 seemed to play more live service types of games, so regardless to how people feel about them, numbers don’t lie and Sony is going where the money is. I mean look at the excitement around Helldivers2, people are showing that they want live service games.

They play long-time existing live service games like CoD, Fortnite, Apex Legends, Destiny 2, and the like. Mass majority of new live service games are considered failures and aren't moving gamers away from older games.

Yep the huge issue with live service is they need paid players along with a reason to play them.

You forgot mobile market that also taps into that player base as well as the eve online style games there is only a certain amount of krakens/whales blind supporters compared to the amount of live service games we have its not sustainable math wise.

700 restaurants making food for every seat for 1000-3000 eaters just does not work out

I am not a big live service fan and literally own zero of the games you listed, but that is not true, unless you call games that aren't the top games to be failures.

There are tons of live service games that are profitable.

Games don't have to be the biggest game ever they just need to make more than they cost.

I challenge you to show professionally prepared data that shows that more live service games fail than make enough to keep going.

Because all the data that I have seen shows that live service is less of a gamble than making a big AAA budget game which needs to survive off retail sales.

I think they did use some but yeah most usually never happened but at least they thought about it. Sony seeks things like this and other, Nintendo seek different ways of playing going by there different controler designs and console designs.
